As Twitchy reported, during arguments over President Joe Biden’s vaccine mandate that would be enforced by OSHA, Supreme Court Justice Sonia Sotomayor came up with a couple of doozies that even PolitiFact couldn’t gloss over. Sotomayor said that the Omicron variant of the coronavirus is just as deadly as the Delta variant and said that over 100,000 children were in serious condition with COVID-19, with many on ventilators.
Justice Elena Kagan said something almost as shocking when she announced that “the government is paying for the medical services so they have the right to dictate details of those services.” It’s not just facts about COVID that are tripping up the justices. Sotomayor had a take that was almost as hot:
Stotomayor says "I don't understand why the states would have power but the federal government wouldn't." That's basically the mantra for her approach to everything. #SCOTUS

That might be how she’d like things to be, but then there’s the Constitution.
I don’t understand why she was confirmed by the Senate. 🤷🏻♀️

Every time she speaks I’m amazed she made it through law school.

She's a wise Latina woman. You're Latina right, that's all you need to be a SCOTUS justice.

This is a "saying the quiet part out loud" moment.

Holy shit.

Fails to understand the foundational core values of our nation.

Wish the reply would have been "The 10th amendment addresses this madam justice."

Lemme see if I can help:
"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
If you need to look it up yourself, Sonia, it's between the 9th and 11th Amendments.

Isn’t that the point of the constitution. To limit the power of govt.
— nonamehorse (@nonamehorse3) January 7, 2022
And that's why they choose to ignore it.
— Patchouli Jim (@PatchouliJim) January 7, 2022
that can't be the actual quote?
— Destructive Governance (@DestructiveGov) January 7, 2022
It is.
— Frank (@richardrahl1086) January 7, 2022
It’s also a basic misunderstanding of how our system is intentionally set up. It’s disturbing that any Supreme Court Justice wouldn’t automatically understand that.
— THE President Elect Great Lelando (@LelandShow) January 7, 2022
It is so infuriating when people in such high levels of govt, with such immense power, do not understand the basic founding principles of our nation. The states created the federal govt, and the 10th Amendment delineates the power dynamic of federalism. It is not rocket science.
— Publius Americanus (@PubliusAmerica2) January 7, 2022
I'm sure she understands it, just doesn't like it and wants to change it.
— Colleen (@royle1959) January 7, 2022
Exactly.
That’s why she was appointed. She will carry that narrative no matter what.
— Stringfellow Hawke 🇺🇸 (@Stringfellow267) January 8, 2022
OOF. That is a bad legal take.
— Not Your Ally (@1234_abcdef1234) January 7, 2022
"I don't understand" was really a theme in all of her discussions today.
— America First (@NarrativeFilter) January 7, 2022
And she wasn’t alone.
