We all knew Brian Stelter would be taking a victory lap today after Jim Acosta’s press pass was given back to him but watching him claim that this was in some way a win for the Constitution may be even more annoying than CNN’s lawsuit.
Ok, it’s not but it’s close.

Seriously how is it a win for the Constitution for @Acosta to have a press pass? How is it not against the Constitution for anyone else to not have one? I understand (maybe) if CNN was being barred, but only 1 reporter's pass was taken..

It really is ridiculous. Jim could have apologized or CNN could have sent another reporter but they didn’t really want to fix the situation, they wanted to make an example of the White House for being big ol’ meanies.

The judge didn't rule on 1A claim, Issued injunction based on 5A takings clause. If the govt gives you something of value (in this case a hard pass) then it needs to follow due process to take it away. Nothing about free press.
