State Department spokesman John Kirby said Tuesday then-Sen. John Kerry used a “non-official” email address to send Hillary Clinton information in 2011 that has since been classified.

The emails between Kerry and Clinton were included among a small batch of records made public by the State Department Friday. It had been upgraded to “secret,” the level of classification in government above “confidential,” but below “top secret.”

“I can tell you the [email] that we talked about being upgraded to secret was sent from a non-official account, and the account from which it was sent is no longer active,” Kirby said of the email Tuesday. “I’ve not spoken to the secretary about his reaction to that being out there.”

            If I’m understanding you correctly, you’re talking about the rule of law. In a functioning constitutional government the political class would be subject to the same laws as everyone else regardless of what their personal desires may be.

            What I’m complaining about is basically the opposite. The Constitution’s strict separation of powers has been bypassed because much of congress, the president and his administration, and the courts are in agreement when it comes to certain points regarding their own culpability to the law.

            When the Supreme Court failed to block subsidies to individuals who purchase insurance through the federal exchange, the rule of law officially ended. They did not judge the law by the literal words on paper, but by their feelings about what the legislature probably meant when they wrote it. Regardless of whether you actually believe that the legislature intended for federal exchange purchases to be eligible for subsidies, the law as written said they weren’t. The supreme court did not determine whether the law had been broken based on the law the legislature actually voted on, but on what they wanted the law to have said.

            If the meaning of the actual text of a law is subject to interpretation based on the thoughts and feelings of the courts rather than the definition of the words used, we are not ruled by law, but by the whims of man.

        Part of the problem is the isolated nature in which our leaders live. Few have held outside jobs (as in non-elected, non-appointed) in decades. It’s obvious that neither Hillary nor Lurch understand how e-mail works, or what the rules are in the real world. This is something that everyone else who has had real jobs and has had to sign statements acknowledging policy and procedures does understand. They also have aides that will do “the little stuff” for them, which further insulates them from real life. It’s why “experience in government” is a false asset.

        I’m trying to figure out a detail in the story. It says that Kerry used private email to send Secret information to Hillary’s private email. This occurred in 2011. Hillary was SoS in 2011. Where did Kerry get Secret information? He wasn’t SoS then.
