As we just told you, the Trump campaign announced on Sunday evening that Sidney Powell is not a member of the legal team:
BREAKING: Trump campaign announces Sidney Powell is not a member of the legal team https://t.co/xgPjI8IkLO
— Twitchy Team (@TwitchyTeam) November 22, 2020
The president had included her as part of the team, however, as recently as November 14:
I look forward to Mayor Giuliani spearheading the legal effort to defend OUR RIGHT to FREE and FAIR ELECTIONS! Rudy Giuliani, Joseph diGenova, Victoria Toensing, Sidney Powell, and Jenna Ellis, a truly great team, added to our other wonderful lawyers and representatives!
— Donald J. Trump (@realDonaldTrump) November 15, 2020
Earlier on Sunday and before the Powell news, Chris Christie called the campaign legal team a “national embarrassment”:
Chris Christie says on ABC that the president’s legal team has been a “national embarrassment.”
— Katherine Faulders (@KFaulders) November 22, 2020
And he pointed out that “they allege fraud outside the courtroom, but when they go inside the courtroom, they don’t plead fraud and they don’t argue fraud”:
"Quite frankly, the conduct of the President's legal team has been a national embarrassment," said @GovChristie on ABC. “They allege fraud outside the courtroom, but when they go inside the courtroom, they don't plead fraud and they don't argue fraud.”
— Jim Sciutto (@jimsciutto) November 22, 2020
He also called out Powell specifically:
On ABC, Chris Christie rips President Trump's legal team as "a national embarrassment." He says Sidney Powell accusing the Georgia governor of crimes without evidence is "outrageous conduct by any lawyer." "Notice they won't do it inside the courtroom," Christie says.
— Kaitlan Collins (@kaitlancollins) November 22, 2020
Chris Christie: "I have been a supporter of the president's. I voted for him twice. But elections have consequences & we cannot continue to act as if something happened here that didn't happen." He says an unwillingness to present evidence "must mean the evidence doesn't exist."
— Kaitlan Collins (@kaitlancollins) November 22, 2020
But it’s not just Powell.
Rudy Giuliani suffered an embarrassing defeat in court on Saturday after the campaign’s suit looking to overturn the results in Pennsylvania was dismissed:
A federal judge Saturday emphatically tossed out President Trump’s lawsuit seeking to overturn the Pennsylvania’s presidential election results — and trashed Rudy Giuliani’s much-mocked performance in his courtroom.https://t.co/aOgz0mh9L8
— New York Daily News (@NYDailyNews) November 22, 2020
The campaign will appeal the Saturday ruling, however:
INBOX: @RudyGiuliani and @TeamTrump are appealing the judicial smackdown they got from Judge Brann last night to the Third Circuit, for reasons passing understanding. pic.twitter.com/Nr4xkisl7r
— Andrew Feinberg (@AndrewFeinberg) November 22, 2020
But that may already have run into a problem as well:
They may need another lawyer to file papers at 3rd circuit as Giuliani is not admitted there and the only attorney currently on the case who is is designated as inactive
— Josh Gerstein (@joshgerstein) November 22, 2020
Giuliani and Ellis said the defeat on Saturday was actually good news because “this is another case that appears to be moving quickly to the United States Supreme Court”:
Rudy Giuliani and Jenna Ellis for Trump campaign:"We hope that the Third Circuit will be as gracious as Judge Brann in deciding our appeal one way or the other as expeditiously as possible. This is another case that appears to be moving quickly to the United States Supreme Court.”
— Craig Caplan (@CraigCaplan) November 22, 2020
But that might not work out either:
They want to get to the Supreme Court. They apparently aren't aware that when you get to the Supreme Court appealing a 12(b)(6), the best thing you get is a remand to the district court to litigate the rest of the case.
— Brad Heath (@bradheath) November 22, 2020
Ellis also lashed out at Townhall’s Guy Benson for a comment he made during an appearance on Fox News:
.@guypbenson is making the same false claim as Dems. Just because one lawyer said we were not alleging fraud in one instance does not mean that statement applies to ALL lawsuits. That’s totally ridiculous.
Please actually read each complaint.
— Jenna Ellis (@JennaEllisEsq) November 22, 2020
Guy’s response:
Judges — who read each complaint in detail — keep handing your team loss after loss in court. And you have not come remotely close to substantiating the wild claims your colleagues have made on television. I hope this tweet doesn’t result in any commentary on my anatomy. https://t.co/fOAOCMcivO
— Guy Benson (@guypbenson) November 22, 2020
Guy is referring to an earlier tweet from Ellis where she accused Frank Luntz of having a “MicroPenis”:
MicroPenis syndrome. Sad. https://t.co/0gOIx64yAv
— Jenna Ellis (@JennaEllisEsq) November 22, 2020
We’re on the same side!
You’re pivoting now from what you falsely asserted on Media Buzz. It’s not true that a statement one lawyer made in one case applies to claims every case.
You’re not the judge, but you should at least know enough about these nationally important cases to competently comment. https://t.co/QgDFjI9uP4
— Jenna Ellis (@JennaEllisEsq) November 22, 2020
And it’s being pointed out to her that, so far, it’s four Trump campaign lawyers that have made this claim, not just the one:
FOUR Trump campaign lawyers told as many judges they are not alleging fraud.
They are—
* Kory Langhofer, in Maricopa County, AZ
* Jonathan Goldstein, in Montgomery County, PA
* Linda Kerns, in Philadelphia County, PA
* @RudyGiuliani, in MDPA@JennaEllisEsq is lying, again. ? https://t.co/gjtvxs0RH4— Adam Klasfeld (@KlasfeldReports) November 22, 2020
