Jeffrey Toobin, CNN’s senior legal analyst and a staff writer for The New Yorker, wrote a lengthy blog post at the latter titled “Clarence Thomas’ disgraceful silence.”
In the post, Toobin heaped criticism on Thomas for not asking questions during oral arguments, categorized his body language as “not paying attention” and noted that Thomas has put on some weight over the years.

Justice Thomas has explained that SCOTUS justices have not traditionally (until fairly recently) asked many questions during oral arguments, which is a statement Politifact rated “true.”
