California judge rules against same-sex couple suing bakery owner

A California judge on Monday ruled against a same-sex couple who were suing a bakery owner for refusing to bake them a wedding cake.

Bakersfield.com reported Friday that Kern County Superior Court Judge David R. Lampe was considering whether to order Cathy Miller to chose between making wedding cakes for same-sex couples or closing down the wedding cake portion of her business.

Danny Freeman of KGET broke the news late Monday night:

The judge ruled that “the difference here is that the cake in question is not yet baked,” and forcing Miller to design and create a cake “would do violence to the essentials of Free Speech guaranteed under the First Amendment.”

The judge also ruled that the fact that the same-sex couple would suffer indignity “is not sufficient to deny constitutional protection” of free speech to the baker.
