It’s possible the VP Mike Pence could have to be the tiebreaking vote:

So McConnell has to wait to confirm Sessions until after Senate votes on Devos to allow him to vote on her and Pence to be the tiebreaker

GOP only has 52 votes, so at this point, DeVos would need the vote of VP Pence to break a possible 50-50 tie

Is there any other Republican Senator who might defect on DeVos or are we just looking at Pence breaking the tie?

If other GOP senators vote for DeVos and Dems vote against, Pence would have to cast tie-breaking vote https://t.co/kallIpst5f

We’ll know what happens before too long.

With this absurd DeVos obstruction (you too, GOP), now would be a good time for an executive order eliminating the Department of Education
