Would Congress continue to be paid during a shutdown? Yes. The 27th Amendment to the Constitution, ratified in 1992, holds that “No law, varying the compensation for the services of the Senators and Representatives, shall take effect, until an election of representatives shall have intervened.” Intended to prevent Congress from voting itself a raise, it also protects members from a pay cut.
