President who gave DREAMers false hope has a lot to say now about what's 'required legally'

Not surprisingly, former President Barack Obama had a lot to say about the Trump administration’s decision Tuesday to discontinue DACA, and his 800-word Facebook post really does throw into sharp relief the differences that made him so beloved among progressives who see it as their duty to resist every effort made by his successor.

Here’s a link to the Facebook post, but here’s the deal: as a lawyer who worked on DACA tweeted last week, any legal challenge to DACA “is very likely to succeed,” and proponents are probably best off crossing their fingers and hoping Justice Anthony Kennedy sides with them when the challenge inevitably reaches the Supreme Court.

That’s because DACA is not the law, and President Trump made it clear he’s putting the ball in Congress’s court. That’s why Obama’s post will ring so nostalgic for liberals who still miss him dearly. Why implement DACA via executive order? Because deporting DREAMers “made no sense” and would have been “cruel” and “contrary to our spirit.” Trump’s decision wasn’t “required legally” — it’s “a moral question,” after all.

But “now that the White House has shifted its responsibility for these young people to Congress, it’s up to Members of Congress to protect these young people and our future,” he continues. He’s sort of right; actually, it’s up to Members of Congress to represent the American citizens who elected them.

The thing is, of course he knew all of this full well back at the time; check out what we said about it being a “stopgap measure.”
