There are just so many people who are going to dislike this (like the majority who said they were happy with their coverage before this all started) and so few that are actually going to “love it” in spite of what Harry said. Even those who “love it” in theory are likely to be ticked off (like this bunch) by the reality. It’s not only not free, you have to pay if you don’t get it! We may not be able to explain it all to people but when they get hit with a stick, they notice.

Don’t you find Republicans like Ted Cruz or in your case maybe Rand Paul (since you said you are leaning libertarian) far more persuasive?     Not too worry If you are to poor enough you can get the penalty waived and be on the expanded medicare plan for life. If you ever get a job and/or raise to be over the arbitrary number of poverty rate you will be fined for your success and have to pay or get insurance.

My memory is a little fuzzy but she was adamant that HE would send her a check and that she didn’t know or care where the money was coming from.

    Easy fix. Claim the correct amount of dependents on your W-2, then when you file claim the same amount. The only way they can collect the fine is to take money out of your tax return. If you have no return, they can not take it out.

            Regarding the Supreme Court decision, part of the Court’s decision was to “send” the Act back to Congress to vote on it as a tax, which it never did. So its invalid.
            On the issue of forcing individuals to become active in interstate commerce, an issue not brought up by the action they were considering, the justices pointed out what future actions need to look for in order to seek a finding of it as unconstitutional..the Court itself revealed what opponents need to seek in order to have it overturned.

            When Obamacare came to the Supreme Court it had a mandatory penalty for those that did not sign up. It was not a tax! Even though the SCOTUS does not have the authority to write tax law, the Supreme Court rewrote Obamacare twice and turned it into a tax in order for it to pass the constitutionality test.

            All taxes have to originate in the house as the Supreme Court has absolutely no authority to write legislation or tax bills. For proper procedure to happen in this case it should have been declared unconstitutional, resubmitted by the house as a new tax bill and then voted on again.

            So much for the claims that the A.C.A. is “the law of the land”. And even if proper procedure had been followed to make it such, the President would have no authority to unilaterally pick and choose which parts to implement as written and which his cronies are exempted from.

States have all kinds of power that doesn’t belong to the feds. Every state in the Union could set up any kind of health care they wanted. Feds do not have that authority. The Supreme Court ruled it as a tax, but here’s a little nugget for you – the ACA bill was written by the Senate. All taxation bills must originate in the House. There are several lawsuits still making their way through the courts about this. It is not as set in stone as you would like, I know. But at least get educated before shooting from the lip.

            You realize that Stuart Butler, the Heritage Foundation scholar who discussed health care reform in 1989 has specifically disavowed that his version of an individual mandate was NOT the same as the Democrat congress passed at the last minute with sweetheart deals and not one Republican vote?

            The same bill that labor unions are now fighting against, as in James Hoffa of the Teamsters saying the O-care act will be “harmful” for “millions” (his word) of families?

            The same bill that has caused business to cut hours from 40 to 30 for many employees because the businesses cannot afford it?

            The same bill that is causing hospitals and health systems all over the US laying off healthcare professionals (including physicians) because they will not be paid enough to provide care?

            The A.C.A. was never intended to work – that’s why legislators were discouraged from reading it before voting for it. It’s just a stepping-stone to the single-payer plan that the “progressives” have been trying to put in place for decades. Now, stupid laws have been passed before and repealed before. This is one that needs to meet that same fate. This legislation was shoved down our throats with Pelosi’s disgraceful remark that we’d have to pass the bill so we could find out what’s in it. The many Unions who were very important is getting their members to call their elected officials and demand this law be passed, were all given exemptions and have now changed their minds after learning about what’s in it. Congress shall make no law that imposes laws on citizens that they’re exempt from…one of our rights…was grossly and arrogantly violated and I imagine even you, EEKman, see the hypocritical nature of the WH and Congress keeping their cadillac health care plans while We The People are stuck with Obamacare. I read last night about a guy with an existing condition and his premiums for the sliver plan is $597 per month but carries an annual $13, 890.00 out of pocket annual deductible. Most plans have a $5,000 deductible per person. Surely, EEKman, you don’t believe that’s an improvement, do you? This man with the pre-existing condition was also told if he didn’t purchase Obamacare his penalty would be $4, 017 and his tax refund would be held and lien put on his house if not paid. So, if we seem like heartless, greedy fellow citizens, please do your homework and learn the truth about this legislation’s impact upon We the People, which includes you.             If I want to be charitable towards someone else (and I am), I don’t need a law to force me to be kind and charitable. And it is very relevant what our country was founded on. The only selfish people I see are the greedy ones who come and TAKE the hard working citizen’s money and give it to someone else under the guise of fairness. Maybe you have big pockets but most of us can’t afford $1500 or more premiums per year and a $28,000 deductible for a silver plan that pays 70/30. Yes, that is what a friend found out he would be required to pay under the ACA. Let me do a little math…at those rates a $40,000 medical bill will end up costing him $49,000 on the ACA plan. And, the young sheeples are shocked to find out they will have to pay a $95 fine (goes up next year) if they choose to opt out – and they are freaking out over a $95 fine? They don’t know the half! I hope Obamacare will implode on itself! And, the democrats may whine that the House is not capitulating this time – but old Harry should not be so surprised; after all his party rammed the un-ACA through with no republicans on board. Well guess what, the republicans don’t want it today either and I hope they continue to hold out. The longer this goes on, the truth will come out…old Harry refuses to help children with cancer and here I thought they were the party that cared so much for the people young and old?

            $95 or 1% of income, whichever is higher. I’m sure many of these folks that are surprised about the tax make more than $9500 per year. Over $9500, the fine goes to 1% of income. $10 an hour full time is 20K per year, so that person’s fine would be $200 (what I made as an admin 20 years ago). These LIVs are going to be in for a real shock come tax time since most starter jobs for kids out of college are in the 30K range now.

        The entire law was NOT ruled constitutional, only the individual mandate as SCOTUS illegally rewrote the legislation to call it a tax. There are still challenges pending on other grounds. For one, since it’s now a tax, and the tax provision was put in by the Senate, and only the House can initiate a spending bill, it’s probably not going to withstand that challenge… unless they have something really juicy on Roberts.

        The ACA was only passed by Congress after many bribes, showing Congress to be blatantly corrupt. Otherwise it would NOT have passed. And just because the S.C. says that a law is constitutional, that does not necessarily make it so. The Supremes’ own biases were used. The Constitution was not followed. Not only that, but the majority (I don’t remember the exact number, but it was about 60%) of the people do NOT want Obamacare. And don’t forget the very stupid remark that “we have to pass it to see what is in it”. And I don’t care what ANYONE says, this country was NOT founded on socialism. Some things are absolutely necessary, but this is not. There are BETTER alternatives, and ALL of them were brought forth by Republicans. Also, if it is so great, why are Obama and his family exempt from it? Congress and their families are also exempt. So are the Supremes and their families. So are most unions! Gee, who does that leave to pay for all of it? I remember when we were told that the more people who were in it, the cheaper it would be. And then that idiot gives all of those exemptions.         The ACA is not a tax, it is a law that has a tax penalty within it. There is a difference. According to the 10th Amendment to the Constitution any power not directly given to the federal government remains with the states. The Constitution does not give the federal government the power over healthcare, Therefore, (despite what the corrupt supreme court has ruled) it is NOT legal for the federal government to force individuals to sign up with obamacare or tax them if they do not comply.

        There’s a difference. People need roads so they have a convenient route to get to a destination. Taxes pay that. But paying for lazy scum who refuse to work and just decide to leech off of the taxpayers is a completely different story. Entitlements are supposed to be a safety net, for when people are trying their best, and just can’t make ends meat or for reasons out of their control can’t find work. I have yet to meet a welfare recipient who isn’t just some fat, lazy drug addict who wants the taxpayers who work for their income to pay their bills.

          Entitlements are problematic, I agree, but I fail to see how requiring the country to obtain health insurance is similar to welfare. We need the population to be healthy so that we aren’t threatened by disease. In peoples’ health, often populations stand and fall together. I don’t like paying for freeloaders either, but I also don’t like seeing them not be cared for and then later cost me even more indirectly.

            People who earn 133% of poverty level and lower do not have to pay for their insurance. It is welfare. It is getting to the point that being unemployed will pay more than the median salary.

            That would make sense if these policies paid for wellness care, but they don’t. Health insurance only treats sickness and disease after the fact. Prevention is what will keep the population healthy. Want to fix that? Look at the subsidies for big corn/big wheat and processed food. These are the main reasons for poor health in the lower classes.

            Most hospitals and clinics will work with patients on a payment plan. I hate to hear that ‘some’ people lose their homes, but payment plans are an option. Also, Americans like to get the “best” treatment, which is also the most expensive (ala Walter White). I also read a really interesting article once (I’ll see if I can find it) about Doctors and their end-of-life plans because they see so many families starting very expensive and painful treatment that only gives a few more months of time vs. accepting the reality that end of life is near (re: elderly patients).

    Just dropped by to say a few things in defense of my generation.

    First off, the majority voting age is now (thanks to the Baby Boomers) the 45+ range. That means that either the majority of people that age voted for Obama or something somewhere is terribly askew. On that note, the PEOPLE don’t vote for president. In fact, we can all vote for Fred Flintstone if we so desired. The ELECTORAL COLLEGE has the final say in who really gets elected. Tough turkey, folks. If you don’t like it, you can get out of my America.
    Secondly, myself and others in my generation (the 30 and below) really do think this is a great idea. We are about helping others, especially within our borders. This is why so many young people are against the current wars; why we speak out against violence inside the U.S. Life for this generation will not get harder because we have to pay for healthcare. In fact, by paying for healthcare, it can only get better.
    My tertiary point is that no one EVER said anything about “free healthcare” and if they did they were terribly misinformed, much like many of you. What we have been talking about since the inception of the ACA is UNIVERSAL healthcare. Universal =/= Free. There is a major difference between the two words. We have always (if we’ve been paying attention) known that we would be paying for it, especially after the government came out and TOLD us that it was a tax!
    Fourth, to appeal to any good God-fearing Christians out there, Jesus taught that we should take care of the weak, the sick, and the hungry, even if it hurt us a little bit. What better example could there be than this? Paying a little more on your taxes to help offset the costs to those who maybe couldn’t have been able to afford it before.
    As a final note: In the future, try to refrain from using “Dirty Liberal Media” like CNN to tout your Neo-Conservative bullcrap. Thank you and goodnight.

          The ACA is not about health CARE. It is about health INSURANCE. And those two things are not the same.

          An individual could get health care even without insurance. Yes, they may have a big bill at the end of it, but often, especially for people with little or no income, it was written off by medical institutions.

          But now, by requiring insurance, people at certain breakpoints in income will find a huge jump in their fiscal requirements for insurance vs care. And heaven help them if they make a mistake on the “benefit” estimate or get a raise during the year.

          But I don’t expect you do to more than recite talking points or incorrect facts regarding this failure.

This bill, however, is designed to help people pay for these exorbitant price increases brought on by drug and medical equipment companies. If they keep raising their prices, they will get heavier fines until they are forced to put out a reasonable price for their goods. We’ll be paying for it, but we will in no way be paying as much as you geezers fear. (payback for the diaper dandy comment)

      As a Christian, I have studied the bible and Jesus was not political. The only political statement he made was “Give unto Caesar what is Caesar’s”, meaning pay your taxes. Jesus’s teachings on charity were directed at the individual and the church, not through mandated fines and taxes by the government. Not once did Jesus state the government should be providing charity. He also said, “The poor will always be among us”, meaning we should always be vigilant in our charitable actions.

      I do not play the game of which political party Jesus would approve of because we have no way to know. However, he never advocated for the government to provide charity, he advocated this on the individual level.

However, I cannot for one moment believe that he meant for us to stand by while sick people suffer and die because they can’t get the help they need simply because they have a family history of diabetes or cancer or heart disease. Not for one instant will I believe that Jesus was so disinterested in the sick or the poor. Secondly, this IS a tax. Plain and simple. This is a tax which will fund a health care system. It shouldn’t matter who is being charitable, so long as charity is offered.

As for your comparison to paying a fine for driving without a license – apples and oranges. If someone doesn’t have a driver’s license and they choose to drive anyway, that is their choice to risk the fine. The fine for not having insurance is a fine imposed on a person for simply existing without insurance.

      The true “burden” on healthcare costs are the millions of illegal aliens who use the ER as a primary care doctor. They are well aware of our law that a person seeking ER care can’t be turned away. They use our emergency room systems for basic healthcare without one concern of ever paying the bill. They have no legit social security number, therefore no legit credit history, so for them to walk away from a hospital bill means nothing to them – they have no consequences to pay. An American without insurance is less likely to use the ER for simple matters because they do have a credit record and think twice about destroying by defaulting on a hospital bill.

      I invite you to visit any ER in the Los Angeles area at any given time. The waiting rooms are over-filled with folks who don’t speak a lick of English, aren’t in any life-threatening situation…they want to see the Doctor because they have a runny nose.

            They need to get rid of it. If this program is so wonderful strike the individual mandate, and let ACA compete in the market with all the other plans. Make health insurance more competitive, whenever a product has to compete with other products, it’s improved upon, and it drives cost lower because more people buy into it, mostly because it’s been made affordable. The person selling wants to sell as much of their product as they can. High volume = Large profit.

            I like that the insurance companies can’t deny coverage for pre existing conditions but we don’t have to change the entire health insurance industry to address that one issue.

      There should be more whites getting government assistance as they are by far the largest single group. While less blacks as a total number receive government assistance, they are waaay over-represented compared to their share of the population.
      Also, “government assistance” is vague. I would bet the average white person on some form of aid is not getting as much as the average black person on aid, such as getting food stamps becaue of a low income or job loss vs. being wholly supported by the taxpayers and never working.

      Here you go – premiums by state for silver and bronze plans, but no mention of coverage. Can’t compare premium costs to current plan without coverage levels because you cannot determine your out-of-pocket to see if Ocare is more expensive or not.

      I live in GA, and yes, via the exchange my premiums will increase about $150 per month. However, work open enrollment has not yet begun, so I do not yet know what my costs through my employer’s coverage will be next year (I’m sure there will be a hefty increase in premiums there, too).

    Will Sheehan claims that when he tried to sign up for Obamacare and then register to opt out, he received an ominous warning. Sheehan’s full Facebook post reads;

    “I actually made it through this morning at 8:00 A.M. I have a preexisting condition (Type 1 Diabetes) and my income base was 45K-55K annually I chose tier 2 “Silver Plan” and my monthly premiums came out to $597.00 with $13,988 yearly deductible!!! There is NO POSSIBLE way that I can afford this so I “opt-out” and chose to continue along with no insurance.

    I received an email tonight at 5:00 P.M. informing me that my fine would be $4,037 and could be attached to my yearly income tax return. Then you make it to the “REPERCUSSIONS PORTION” for “non-payment” of yearly fine. First, your drivers license will be suspended until paid, and if you go 24 consecutive months with “Non-Payment” and you happen to be a home owner, you will have a federal tax lien placed on your home. You can agree to give your bank information so that they can easy “Automatically withdraw” your “penalties” weekly, bi-weekly or monthly! This by no means is “Free” or even “Affordable.”

    Sheehan went on to point out that the site makes you input all your personal information before giving you an indication of the costs, meaning a database of the “uninsured” is being built. He added that he could not afford to pay the premium so would have to break the law and pay the fine, leaving him with no health care coverage.

      That person may or may not have received that email, but there’s no truth to it. The Federal Government won’t be suspending driver licenses, putting liens on property, etc. and no black helicopters are going to follow you around. From everything I’ve read, all they will do is deduct the fee from any Federal tax refund. If you don’t have a refund coming, they keep the fine on your record until such a time you are entitled to a refund and it will be deducted. The Federal government doesn’t even have the authority to suspend a state issued driver license over a tax issue. Alex Jones is spreading a whole bunch of bullcr*p, but what else is new?

          It’s actually written in the law that way. Have a look:

          Patient Protection and Affordable Care Act: In the case of any failure by a taxpayer to timely pay any penalty imposed by this section, such taxpayer shall not be subject to any criminal prosecution or penalty with respect to such failure.

          Patient Protection and Affordable Care Act: The Secretary [of Health and Human Services] shall not file notice of lien with respect to any property of a taxpayer by reason of any failure to pay the penalty imposed by this section … or levy on any such property with respect to such failure.

          Now, if you want to assume they will do otherwise, that’s a whole other conversation. But the FACT is, it’s written into the law all they have the authority to do is deduct the fine from refunds.

            My understanding is that it’s a fee. A fee imposed by the HHS, not a tax owed to the IRS. The IRS involvement is simply a collector of the fee, the money goes to the HHS. The IRS doesn’t have the authority to file liens for the collection of a fine imposed by another agency. The IRS is the middle-man, a bill collector and they have no authority to take any action other than collect the money at tax time.

      First of all, I wouldn’t trust anything on Alex Jones’ website. He’s nothing but a fluffy nutter. The “fine” is supposed to be $95 or 1% of your income, whichever is higher, not 10%.

      The only thing I would do, is make sure you have high deductions on your W2. It would be better to set that money aside and pay your tax bill instead of receiving a refund in case you opt out of insurance.

        the fine goes up and it is on your Mandated Income. So all people in your house that work, that income is added up, because you fill out the form and then the fine is assessed. Secondly the IRS is printing up a Mandated Tax Form. so that form will be filled out when you do your taxes. Mandated Income is much different than your income on your W2.

        I know others like my best Friend Tammy who has a pre existing Condition that has to do with her thyroid. She is a home health aide, and she does not get insurance through her employer because she is contracted. She doesn’t qualify for any help in Michigan because she makes to much. So she thought she could get help with her pre existing condition through Obamacare. SHE WAS TOLD THEY ARE OUT OF MONEY !! for people with Pre Existing conditions. so I checked, and it was announced in April on the PCIP website that there is NO MONEY.

        the fines are based on your income, a guy signed up yesterday, gave them the info and was put on auto pay $4250 a month 3000 deductible, found a better deal tried to cancel, canceling would result in nearly 20,000 dollars in penalitys, he had a pre-existing condition but had lost his insurance when aca came out

Now, you pay wa-a-ay before being treated, then pay a deductible as high as $5000.00, then, a co-pay each time you’re treated. So, if you’ve been saving for a car or anything else, forget it.     I read that that the penalties just keep growing and growing up to $4K per year if you are a person that makes $40-$50K per year….I don’t know if that is a fact but if it is…also stated that if you don’t pay your penalties it will be just like a tax lien the govt can put a lien against ANY property that you own…your home vehicles etc. WTF???? That is why it was put in the hands of the IRS to handle. Wake up people.

    ok here’s the deal…Jan-April when we did taxes we EDUCATED our clients that a fine would be put on them if they did not get health care…people…this was at the beginning of the year! OF COURSE IT’S NOT FREE!!! If you would have done your research you would have known that!! The first year of no insurance is nothing compared to the penalties you will face NEXT year!! It nearly triples!! And YES it will come out of your tax returns or will be part of what you pay in!!

    The 1st year penalty is NOT LIMITED to 1% of your income! It says: 1st year fine is 1% of your income, OR, 300% of your INSURANCE COST, whichever is GREATER!
    Now you see why people are receiving fines of 1,000’s of dollars.

    Guess everybody who hated Reading Comprehension and said they’d never need it was dead wrong.

One, it is bound to collapse under its own weight, and two, it is a blatant invasion of privacy and liberty. Wait till you find out that they can suspend your Driver’s License (failure to comply) and then FINE you AGAIN when you go to get it re-instated or are stopped by an “informed” cop who was tipped off that you’re driving on a suspended license (the fav trick of cops to get the lower class miscreants and harass them when they need revenue or intimidation). Wait till they send in the IRS to AUTO withdraw your IRS penalties from your checking count and your auto-mortgage payment BOUNCES for insufficient funds and you get FINED AGAIN by the Bank AND your Mortgage Company with a few hundred dollars in returned check fees. Then if you don’t get it ALL resolved in 24 months – WAIT till they put a tax lien on your house and have to spend hundreds more in interest fees and attorney’s fees to get that removed! YOU LIBTARDS – WE TRIED TO WARN YOU that OBAMA is a FASCIST.

      You have to make $11,500 to qualify for a federal subsidy so that you can actually afford insurance. Anything below that either comes straight out of your pocket (just as earning 138% above poverty would) unless your state opted to expand Medicaid. If they DIDN’T, you’re stuck with the fine unless you decide between health insurance and a mortgage payment.

      This fine goes up to more than $600 by 2016.
