As Twitchy reported in November, arts and crafts store Hobby Lobby had turned to the courts to challenge language in Obamacare that mandates that employers provide contraceptive coverage. A U.S. District Judge had ruled that, because Hobby Lobby was not a religious organization but a for-profit business, it was not exempt from Obamacare’s requirement to provide morning-after and week-after birth control pills as well as some intrauterine contraceptive devices.

Today, Supreme Court Justice Sonia Sotomayor declined to grant an injunction to Hobby Lobby and to another business, Christian bookstore Mardel. The businesses say they face devastating fines if they do not provide contraceptive coverage beginning Jan. 1, but that wasn’t enough to sway the court.

In part, Sotomayor wrote that, “while the applicants allege they will face irreparable harm if they are forced to choose between complying with the contraception-coverage requirement and paying significant fines, they cannot show that an injunction is necessary or appropriate.”

We were assured that we’d like Obamacare once we found out what was in it, but not everyone’s happy about the government’s expanded authority to mandate coverage.

  • Moriah Jovan

Speaking as someone who adores Hobby Lobby and everything about them, I hope they close up shop. Either the fines ($1.3M per DAY) or legal fees will bankrupt them, but both at the same time will make their death that much quicker.

  • Jason

Obamacare Nazis hard at work. What happened to the country I used to live in??

    • Zane Henry

It was sold out by the crowd that was tricked into believing there is an infinite number of tireless providers out there who exist solely to pull in their slack. Fun, ain’t it?

    • Maureen T. McClain

Speaking as someone who adores Hobby Lobby and everything about them, I hope they close up shop.

      • Catchance

Unfortunately, that would mean that many more people losing their jobs. I hope they can work something out.

      • Jillane Kent

Doesn’t it get hard to come up with semi germane comments in your endeavor to spam the internet?

      • Terry

I hope they stay open and when their 1.3 mil tax bill comes they rip it up into little pieces. The jerks in DC would love nothing better than to have Christian owned businesses close up shop. Let’s stand our ground!

    • fmahoney

The south lost the war & this election, Women have rights and the general public has access to information via the internet and mass media.

I suggest you move to the moon,

      • Grandma HeadInjury

….and I suggest you start making sense.

      • Hiraghm

Women have rights. Do they have rights men don’t have? Then don’t men have rights women don’t have? How about left-handed, bi-sexual, red-headed minor-league pitchers.. do they have rights right-handed don’t have? Rights non-hermaphrodites don’t have?

Women have the same rights as men… and the same responsibility. They do NOT have a right to contraception on my dime.

There can be no rights that put a burden upon others to provide them, such as the touted “right” to healthcare.

        • fmahoney

Your dime? Your dime? Give me a break how much of your dimes goes to private prisons financed by the federal government???
5.1 billion on your dime to keep some idiot who is smoking wild weeds. So pay for a condom or birth control now or pay for the criminal nobody wants @ a rate of $60,000 per year per prisoner

Now let’s talk about what Enron cost was to the united states of America. Energy companies receive between $10 – $35 Billion in U.S. Taxpayer Subsidies. Kenneth Lay / Enron was the largest career contributor to the Bush Family.

Now, your Republican backed ENRON did not set it’s sights on Republicans, Democrats or Independent members. Enron did not care if you were a right winger or on the left. The only thing that made these people happy was money and more money, Greed! at the cost of all Americans.

God Bless Obama and the United States of America

          • Jillane Kent

Why is it considered greedy to operate a company while still adhering to your, ostensibly, Constitutional religious rights? Why do you consider it inherently greed to preserve the fruits of your endeavor from a capricious government that has proven itself to not be a good steward of your monies?

          • fmahoney

Why do you guys set a new set of rules when it comes to another party. I grew up christian, Seventh Day Adventist to be exact. Very conservative religion.

However, that is my religion and my choice. I would never force my believes on any member of my management team or low wage workers.

Thou shall not kill is one of the 10 commandments but you have no problem blowing off someones head who enters your property. You don’t want to slow him down, stop him or disarm him your objective is to end his life for the infraction.

What bothers me is the double standard.

I work hard and play hard and the hell with anyone who wants to take my hard earned money.

As I grew older I learned some valuable lessons. Pay your workers good make certain they are ok and they will take care of your business.

In life we do what is best for the family first, thin the community, then the state, then the country, then the world.

See I can’t decide why some women have abortions, However, I could never be so intrusive in a woman’s life to suggest or force my believe or opinion on any woman. That’s between her, the doctor and God. Who should make this decision about who should keep a fertilized egg? You

My ex-wife had fibroids, big ones and having a child could have killed her. If my wife got pregnant, your telling me you get to decide if my family is willing to take a chance of loosing my wife. You don’t want the federal gov invading your privacy but you want to dictate to my wife me because of your religious believes. I don’t think so buddy that’s between my wife, the doctor and my God

Remember the seventh day to keep it holy? Should this be the law of the land? Should every shop and biz be closed down?

            This is America remember.

          • Mister A

There is no standard. Practically all standards seem to have sunken to subhuman levels including respect for one another. Your political leanings matter not. Take care of your family. No legislation will stop that from happening. However, be aware of who and what you praise. You are giving away your rights willfully. The new normal is high unemployment, massive unsustainable debt via insolvent govt programs, zero accountability, zero transparency, and an unrelenting trend towards bondage. The value of each paycheck (be it govt cheese or hard-earned cash) drops every day. We have perpetuated a centralized system that continues to mislead us all. Believe in what you like, but understand that the future is dire. That is America.

          • Hiraghm

First, “why some women have abortions”. I don’t object to women controlling their own bodies… if they would control their own bodies.
Second, I don’t know why some guys go off half-cocked and shoot up schools, but I do insist on trying, convicting and executing them when they do, because murder is against the law.

See, I’m not against abortion on any religious grounds; I insist upon equal protection of the law. If some bitch in heat can murder her innocent, unborn child because she wanted something hot and hard between her legs but didn’t want to be responsible for the results the act is designed to achieve, then I should be able to blow the head off my illegal alien neighbor for being an inconvenient burden, as well.

As for your wife’s fibroids… there’s an exception to the murder laws known as “self-defense”. I’m perfectly okay with a woman killing a child which would threaten her life.

But, did it ever occur to you, that if getting pregnant were a threat to her life… maybe, if you can’t afford a rubber, diaphragm, the pill, tubal ligation, vasectomy or castration yourself… maybe you shouldn’t screw her?

Why should your employer have to pay to keep her from getting pregnant when he doesn’t get the pleasure of topping her?

          • MissDiane47

FYI – You’re right, it is between you, your wife, God and your doctor. But YOU, your wife and your doctor have no right to demand that the rest of us pay for your medical decisions. THAT, my friend, is what this is about!!

          • Sheldon Cooper

It’s actually, “thou shall not murder”. There’s a difference.

          • Jillane Kent

You are falsely assuming that all individuals in this country are motivated by religion, simply because they support the rights of the religious. I am agnostic, yet recognize that the government should not intrude upon the rights of the faithful to operate their companies in the manner they so choose. As an employee, it is recumbent upon them to determine if the terms of employment are something they can live with. The medical decisions that you and your wife make are up to you. The responsibility for your family’s health is yours. Consequently, if something is that important to you, why would you not pay for it yourself or find an employer that had no reservations about subsidizing it?

          • Shawn Smith

You seem to be confused. That last statement of yours is self-contradictory, just ask Jeremiah Wright. It’s God bless Obama and God damn America!

          • Hiraghm

Yet another socialist, anti-capitalist scumbag reveals the true bigotry inherent in many who gravitate naturally to the left. A woman has a child because she’s part of a society that no longer values marriage and morality, and it’s automatically assumed that A) she is unable to raise the child properly, B) That even if the child is raised properly, he will automatically revert to “an idiot who is smoking wild weeds” and a “criminal”.

People who think as you do seem incapable of handling the concept of sovereign individuality; the uniqueness of each human being. You seem compelled to lump us all in to whatever group is convenient for your agenda du jour.

          • Sheldon Cooper

Obama is beyond the reach of God’s hands. He11, he thinks HE IS God.

          • sally1137

            Straw man much?

      • Terry

As a female who wants no part of ‘morning after’ or any other aboritifacients, I sure as hell don’t want to pay for yours either. What about MY rights? Or don’t I count because my avatar is a generic man suit?

      • Jillane Kent

        A) How is the Civil War germane?
        B) Why should the government be in the business of forcing companies to provide coverage for abortion inducing drugs that they have moral qualms against?
        C) Do liberated women not have the ability to contract their labor with companies that best suit their expectations?
        D) Are women so weak and financially bereft, in your worldview, that they need a paternalistic government to take care of them?
        E) Why are you leaving men, a necessary component to conception, out of equation?

    • $36544368

I hate to say this…because I never thought I’d really entertain this idea…but sometimes I wonder if I can continue to live in a country like this…I’m constantly anxious, scared, and worried about my future and that of my children. Some days it consumes me…I have become frightened to leave my house sometimes. Seems like my world continues to get smaller and smaller each day.

      • Hiraghm

        Who is John Galt?

        • $36544368

Is he not a fictional character in “Atlas Shrugged”?

          • awm48

You have the facts, but not the meaning.

          • $36544368

            I answered your question.

      • Sheldon Cooper

The question is, where would you go? This whole world is being swallowed by these liberty grabbing, morons. You have 2 choices: succomb or stand your ground.

        • EastValleyConservative

Exactly Sheldon. The good news (and bad news) is that this type of government fails every time. Granted, we will be left to pick up the pieces when the takers finally realize you can’t tax, borrow and spend into any prosperity. I am willing to bet maybe 1/3 (could be less) will wake up to the harsh reality that we had the right idea the first time around. The others will continue to throw Greek style tantrums in the street. So, yes, let’s stand our ground. We may fail time and again against the powers that be, but it eventually runs out.

    • EEKman

Relax wingnuts. There’s nothing preventing the supreme court from hearing this case in the future. Since none of you actually read the supreme court opinion and are apparently ready to move out of the country to escape an imagined socialist coup, i’m doing you a favor. Put down your bags and your Impeach sotomayor signs and relax.

“Even without an injunction pending appeal, the
applicants may continue their challenge to the regulations
in the lower courts. Following a final judgment, they may,
if necessary, file a petition for a writ of certiorari in this Court”

      • Ronald

        The voice of reason.

  • thetreyman

the only thing that is going to stop this is if the government actually starts jailing people for not complying. then their might be enough of an outcry to change the mandate. i fear we may be stuck with the rest of the sh!t sandwich though. the republican leadership doesn’t have the will to fight for freedom anymore. dark days are ahead my friends.

    • fmahoney

What would Jesus do about healthcare? Do you think he sent a bill to the man he made see??? What do you think the deductible was??? WOuld your lovely insurance companies sue him for malpractice due to the fact he was not formally trained at a board certified MEdical School?

Be like jesus help the poor. Do you have a hint how much we send to Israel?

How much did the fake war cost in cash and lives?

      • thetreyman

i dont recall jesus using government to force people into private contracts. what bible have you been reading? you have a very skewed view of freedom.

        • Ronald

He just said, “Render unto Caesar the things which are Caesar’s, and unto God the things that are God’s”

      • Jillane Kent

How much do we send to nations that wish our demise? Defense is in the Constitution, by the way. Show me where charitable action for the poor exists, beyond a loose interpretation of the elastic clause.

      • Lovetorun2

Jesus woudn’t “force” healthcare on anyone. He never “forced” anyone to be healed. And he called on the extended family and the church to help those in need, not the government. (see 1 Tim. 5:3-10, 16; James 1:27).

      • Hiraghm

BINGO we have a winner… “how much we send Israel”… can you say “anti-Semite”? I knew you could.

Do you know how much we send Egypt?

I can’t be like Jesus, your government won’t let me. See, God gave us this thing called “free will”, and if the government takes my money and spends it how the government judges as helping the poor… I can not emulate Jesus because the government has decided that emulating Jesus is so good, it’s mandatory, and the choice to do good or ill is taken from me.

I’d check out how much companies like Hobby Lobby and Chick Fil A (and MacDonald’s, for that matter) do for charity before condemning them for not signing onto a government mandate they find intolerable.

There’s an old science fiction story about the battle of Armageddon. The generals, hundreds of miles from the battle scene, are directing their robot army to battle the forces of hell. Robots wielding atomic weapons battle demons straight out of the bowels of the underworld. The battlefield is so deadly, anyone who went there would last only seconds.

The priests tried getting the generals to let them, or anyone, participate in the battle, and they were refused.

When the battle ended, the Spirit of the Lord walked among the fallen robots… which rose and ascended with Him into heaven, leaving the rest of us behind.

No thank you, and again, I thank you. I have no use for charity-by-proxy.

Btw… how are those among us who are already sucking off the government teat, to “be like Jesus” and help the poor, thereby achieve the salvation-through-deeds you seem to think de rigueur?

  • Palin ECoalition

Sotomayor shouldn’t be on the Supreme Court in the first place. How can we remove her?

    • Paul Bartomioli

we the people cannot. She can resign or die; once a judge is appointed to SCOTUS, they are there for life. There is no “recall” or election that can be held.

      • Hiraghm

even SCOTUS judges can be impeached.

    • fmahoney

Let’s face a simple fact if Sara Palin is your hero your too stupid to figure out how to remove a seat belt. Go back to High SChool and take SCOTUS 101 or pick up the book Scotus removal for dummies. I am certain Sara Palin has a copy

      • Ronald

    • LeftistsStink

A Supreme Court Justice may be impeached by the House of Representatives and removed from office if convicted in a Senate trial.
Let’s get the Senate and then impeach Roberts and all the other Leftists, as well.

  • Peyton

How come sotomayor was the deciding factor?

    • GaryTheBrave

Each Justice is assigned a Federal judicial district they oversee. Whatever district Hobby Lobby is headquartered in is likely overseen by Sotomayer.

      • Catchance

This was an emergency injunction, so that they wouldn’t have to pay the horrendous fines imposed upon them beginning January 1st ($1.3 Million per day) for non-compliance. Their case will still continue, through the lower courts first, and if necessary on up to the Supreme Court.

      • Peyton

Thanks Gary. And who made the decision to file it in Sotomayor’s district? Poor decision.

  • aPLWBinAK

Given that a lot of waivers have been handed out, I guess it’s a safe bet that Hobby Lobby isn’t on ‘the list’.

    • Zane Henry

They didn’t purchase their indulgences via contributions to the Bend Over, i mean, Forward campaign.

  • KStrett

“while the applicants allege they will face irreparable harm if they are
forced to choose between complying with the contraception-coverage
requirement and paying significant fines, they cannot show that
an injunction is necessary or appropriate.”

Choosing between violating your conscience and fines that put you out of business isn’t showing that an injunction is necessary or appropriate?

  • disqus_XtVvhtkYwo

Can’t they just do away with insurance coverage all together? Do what so many others are doing, no more full-time therefore they don’t have to offer benefits. I say we should fight them with their own ammunition, give them exactly what they want and maybe, just maybe the people will wake up and see exactly who really is the bad guy here.

    • Jillane Kent

According to the edicts of the health care law and the size of their company not offering insurance really wouldn’t be an option, would it?

      • Jim Denney

A lot of companies find it will be cheaper to dump insurance for the employees and pay the fine.

    • ceyanne

I’m not sure if I understood my friend (who owns a small business) correctly but I thought she was saying her accountant told her that if you have a co. with, say, 102 employees and you cut their hours to P/T in order to avoid having to offer insurance, the gov’t/Obamacare will count 2 p/t workers as 1 F/T work and say that you actually have the equivalent of 51 F/T workers and fine you as such if you fail to provide health benefits. So companies would have to reduce their staff to 99 part-timers or less in order to avoid offering benefits or the fine. He also told her that the accounting industry is really at a loss as to how to advise their clients on financial matters now b/c while the gov’t has declared that there will be fines and penalties on businesses for various things, on more things than just healthcare stuff, the gov’t is not bothering to say WHAT the guidelines are so a business owner may not be aware that they are violating some code. Does that makes sense? Let me see if i can find the email… here it is:

“You know we have our own trucking business, right? I had a chat with
my accountant yesterday who said small biz and middle class+ don’t even
have a CLUE how badly new tax changes already in place (Obamacare,
Medicare, inability to write off stuff we used to be able to) are going
to hit us, let alone the Bush cuts expiring or fiscal cliff remedies.
He personally has several clients who are giving up their biz b/c even
dropping employees to PT isn’t a way to get around Obamacare. WH is
implementing a formula of hours per week times number of employees such
that, say, 100 PT workers will be equal to 50 FT, which means biz still
won’t be able to afford Obamacare, if that makes any sense to you (I
have heard no news coverage of this, have you?).

He said from an accountant’s perspective this administration has caused complete and total chaos. They’re passing laws and not properly following through on their end, yet promising to fine or penalize. There are no info
sheets, forms or classes to take to even keep up or be informed HOW to
advise his clients about the new regulations — the IRS can’t even
answer his questions (which needs hundreds more employees to institute
Obamacare and hasn’t even started hiring b/c they have no money to do
so). PLUS, that FT/PT thing I talked about…starting Jan. 1 employers
are supposed to be tracking every single working hour of every single
employee and most companies don’t even know what steps they’re supposed
to be taking now b/c nobody is informing anybody of anything. That ^ is the abbreviated version. My mind was blown, talking to him.”

      • Hiraghm

I foresee “contract labor” becoming very, very popular in the future.

      • sally1137

The S is gonna HTF any day now. “We have to pass it so we know what’s in it.”

        It’s asolutely insane.

    • awm48

Except that’s exactly what the law was designed to do. They want everyone to have to get their insurance/healthcare from the government. That is literally the power of life and death!

  • michael s

Obamacare is the law of the land.DEAL WITH IT. Let the people from hobby lobby eat a twinkie.

    • digitalPimple

Doesn’t mean it’s a good law or that it works… wise up.

    • SonsOfMontesQ

…and at one time in our history, the allowance of slavery was the law of the land. what’s your point…

      • eddie333

Slavery is destructive, destroys life. Abortion destroys, too, before innocent life has a chance to begin.

      • Jillane Kent

I don’t believe he has a coherent point, other than a bizarre adoration of all things liberal and a decided deficit of graciousness.

    • Shawn Smith

See here’s the thing, most conservatives believe there is a higher law than whatever happens to be passed by congress. This conflicts with that higher law. It being “the law of the land” is entirely beside the point.

      • Hiraghm

More to the point, the “Law of the Land” is the Constitution, not bills passed by transient legislators and overseen by ineligible executives. This conflicts with the “Law of the Land”. See Amendments 1, 9 and 10.

        • Shawn Smith

Seriously, what parts of the liberal agenda over the past 50 years would stand against the tenth amendment? Really, just give me my Bill of Rights back.

    • Severe Conservative

“Slavery is the law of the land. DEAL WITH IT.”

      • fmahoney

Your not being nice that was mean. I agree with you and that;s why we will ban certain guns from killing little children. While we are changing things let’s change the constitution, the only constant in life is change.

I would bet you guys enjoyed that free labor and target practice from those lazy blacks. Maybe you can reinstate slavery and compete with China low labor

        • awm48

More little children are aborted every day than have been killed in all these massacres put together. Hypocrisy of the left.

    • Jillane Kent

Prohibition was once the law of the land. People didn’t exactly “deal with it”, did they? Once abortion wasn’t legal in all states. Did liberals simply “deal with it”?

    • Grandma HeadInjury

You sound vaguely like Marie Antoinette. One can only hope you follow in her footsteps completely…

      • Hiraghm

Madame Pompadour, Marie Antoinette’s aunt by marriage, iirc, was the one who *may have* uttered the infamous words “if the people have no bread, let them eat cake”. Unfortunate Marie Antoinette, ally to The United States of America, has been branded with that infamous sentence ever since it was first used to slander her, by SOCIALIST SCUMBAGS.

In the words of Sean Connery in, “The Untouchables”… here endeth the lesson.

        • Grandma HeadInjury

    • Mister A

What’s even funnier is that laws matter less and less. This is what happens when you have a lawyer in office. Words mean nothing, and laws and rights are debased. We will all be dealing with it soon enough.

  • $29520529

How fun for all the Zero supporters! You think you have won, ummmm sorry, companies like this will have to lay you off, forcing you into Government health care where you will wait in line for services, and in the end your loving government will determine you should not live, at that point please praise your Obama your lord and savior. Unfortunately the True God doesn’t recognize Obama as his son and your sins are therefor not forgiven. Good luck then.

It’s not the Supreme Court’s decision, but that of obamao puppet and communist Sotomayor. There for invalid. Keep going, Hobby Lobby.
