House Judiciary Republicans just put a name and a paper trail on what Arlington County has been doing in practice.
Commonwealth’s Attorney Parisa Dehghani-Tafti is accused of running a two-track system: citizens get charged, illegal aliens get a workaround, and DACA recipients facing DWIs can be steered onto a “lateral charge” so their status stays intact.
We can't even make this crap up.
The county’s own trust policy, the GOP report says, even tells local cops not to initiate contact with ICE — violent felons, gang members, traffickers, and terrorism suspects included. ICE detainers get ignored, the suspects go back onto Virginia streets, and Arlington still wants credit for keeping people “safe.”
That’s not equal justice.
That’s a preference.

Arlington County can call it a “trust policy” all it wants. What House Republicans laid out is a system that treats citizenship like a liability and illegal status like a get-out-of-consequences card. If you live there, you can still get charged. If you don’t, the office looks for a lateral charge, the cops are told not to pick up the phone to ICE, and the detainers collect dust while the suspect walks back onto a Virginia street.
That’s not compassion. It’s a preference for the defendant over the neighborhood. And if this is what one county will put on paper, the rest of the country should stop pretending these policies are harmless.
