Hoo boy. Fun times over at the DOJ:
BREAKING: Acting Atty Gen, an Obama admin. holdover, tells DOJ not to defend Trump immigration order as she's not convinced it is legal – DJ

whoa, via @evanperez: Acting AG, an Obama appointee, orders DOJ not to defend refugee exec order, doesn't believe its lawful. pic.twitter.com/pSf0i3wj3g

This’ll end well. Definitely.
it is lawful and the acting attorney general is a clown https://t.co/JP9qQvKFmK

This isn't a POTUS not enforcing or declining to defend a law, it's an executive order. This is the bureaucratic equivalent of mutiny.

I don't like the policy, but she's got to go. It's the gig. https://t.co/t3Miygf23b

Last words to conservative blogger and attorney Gabriel Malor:
This is extraordinary, and nothing good will come of it. https://t.co/GZVW8h6qfh
— Gabriel Malor (@gabrielmalor) January 30, 2017
so trump fires yates now, right?
— Sam Stein (@samstein) January 30, 2017
Yes, but there's a trade-off. At the moment, Yates is the only Department official authorized to allow FISA warrant applications. https://t.co/lyOeLZECBc
— Gabriel Malor (@gabrielmalor) January 30, 2017
Note, there's a bit of a conflict here. WH has said OLC reviewed the EO. Is Yates' decision consistent with what OLC found?
— Gabriel Malor (@gabrielmalor) January 30, 2017
AAG Yates' decision is just another extension of the Obama Rule: declining to enforce laws he didn't like. Time for Trump to adopt it.
— Gabriel Malor (@gabrielmalor) January 30, 2017
See final paragraphs here, for what should happen next: https://t.co/yAZkYxpUe1
— Gabriel Malor (@gabrielmalor) January 30, 2017
Trump should order EPA not to enforce the WOTUS rule, and DOJ to not defend it in court and watch Democrats squeal.
— Gabriel Malor (@gabrielmalor) January 30, 2017
The one area where we know Congress can delegate total authority to the Executive is immigration. Yates' decision is baffling.
— Gabriel Malor (@gabrielmalor) January 30, 2017
Who expected it would be an Acting AG who created the constitutional crisis? DOJ is a creature of Congress, subject to Executive control.
— Gabriel Malor (@gabrielmalor) January 30, 2017
There is simply no constitutional mechanism for DOJ to exercise authority independent from Congress' delegation and the Executive's control.
— Gabriel Malor (@gabrielmalor) January 30, 2017
Serious Q: Can Trump fire the Acting AG?
— Political Capital (@Political_Index) January 30, 2017
Of course. He can also appoint, for a limited time, a new Acting AG from within DOJ. https://t.co/Q2uts0HcLS
— Gabriel Malor (@gabrielmalor) January 30, 2017
This is a very weak justification for refusing to defend Trump in court. No good will come of this. pic.twitter.com/FvK14FvOHb
— Gabriel Malor (@gabrielmalor) January 31, 2017
"I am not convinced" is a terrible reason to order DOJ attorneys not to defend the EO. Ambivalence does not justify inaction.
— Gabriel Malor (@gabrielmalor) January 31, 2017
In light of the ongoing coup attempts at Justice and State, the GOP Senate should confirm all of Trump's nominees by COB Friday.
— Gabriel Malor (@gabrielmalor) January 31, 2017
I was not a Trump voter. But there can only be one federal government of the United States. Trump's nominees must be confirmed ASAP.
