Pablo Villavicencio, the Ecuadorian immigrant detained after delivering pizza to a NYC military base, ordered released

Pablo Villavicencio, the Ecuadorian immigrant detained by ICE on an outstanding deportation order discovered while he was delivering pizza to the Fort Hamilton military base in Brooklyn, NY, was ordered released by a Federal judge on Tuesday:

And Villavicencio has already been released:

From NY1:

Six hours after hearing legal arguments, U.S. District Judge Paul Crotty ruled that Villavicencio can remain in the United States while he exhausts his right to try to gain legal status.

“Although he stayed in the United States unlawfully and is currently subject to a final order of removal, he has otherwise been a model citizen,” Crotty wrote.

“He has no criminal history,” the judge added. “He has paid his taxes. And he has worked diligently to provide for his family.”

Judge Crotty was formerly the “city’s top lawyer” under then Mayor Rudy Giuliani:

As we told you before, Villavicencio agreed to self-deport in 2010, but stayed in America and eventually got married:

In summary, Villavicencio showed up at the base and didn’t have a Department of Defense ID. He was directed to go get a “day pass” at a security desk when a background check, which he consented to, turned up an active ICE warrant as he had agreed to self-deport in 2010 and didn’t do it
