The quite predictable spin of "never happens" to "rarely happens" to "happens often but that's not a bad thing" can be applied to many issues, especially that of noncitizen voting (that the Democrats don't want to stop). But now we have a new part to add thanks to one of the judges who tends to swoop in and try to lend a hand to the Democrats when it's needed.
A few days ago, Brett wrote about Democrat Sen. Alex Padilla, who continues to claim that stories about noncitizens voting in U.S. elections are "conspiracy theories" and yet is angered by efforts to stop the thing that he says never happens:
RIGHT NOW: I’m calling on Secretary Mullin to stop using DHS to interfere with our elections.
— Senator Alex Padilla (@SenAlexPadilla) September 29, 2026
He knows his election conspiracy claims about noncitizen voting don’t hold up. Yet DHS is still conducting its potentially ILLEGAL ELECTION OPERATION.
Every eligible American has the…
A "conspiracy" eh?
The Democrats are the ones supporting the election interference by not wanting this to stop:
BREAKING: A federal grand jury just indicted 10 foreign nationals in Minnesota for illegally voting.

Brazil. Ghana. Liberia.
They voted in 2022, 2024, and this year’s primary.

Now here's one for the "it's come to this" file:
JUST IN: 🇺🇸 US judge rules law criminalizing noncitizen voting is unconstitutional, NYPost reports.

US judge rules law criminalizing noncitizen voting is unconstitutional in blow to Trump https://t.co/kO5BkTEfL9 pic.twitter.com/F4B0MsUC7x

That thing that never happens happened again, and this judge helped the Democrats ensure that it keeps happening.
A US judge dismissed a federal case on Thursday that accused a Jamaican national of illegally voting, finding the law criminalizing noncitizen voting was unconstitutional and delivering a blow to the Trump administration’s campaign against alleged election fraud.
The ruling by Miami-based US District Judge David Leibowitz applies only to the case of Florida resident Chelsea Cox, who was charged in October 2025 with illegally voting in the 2020 election.
It is not binding for judges in other cases.
It's illegal for noncitizens to vote, but it's illegal for the government in some cases to press charges and enforce the law. Make it make sense.
The big pivot has been completed.
We have pivoted from "Non citizens aren't voting!"
— Lauren Chen (@TheLaurenChen) October 3, 2026
To "Well. Actually, it's illegal for you to stop nonvitizens from voting." https://t.co/rBoyeZ9hwZ
"it's not happening!"
— Leo (@RealAmericanLeo) October 3, 2026
"It's not happening enough to matter!"
"It's happening, but it's acually a good thing!!"
Every. Single. Time.
We can now add "and it's unconstitutional for the Trump administration to try and stop that illegal thing from happening" to the list.
