The administration’s preferred “Sergeant Schultz” defense of “I know nothing” isn’t going to work in the case of the Justice Department’s criminal investigation into Fox News reporter James Rosen. NBC News is reporting tonight that Attorney General Eric Holder personally signed off on the search warrant naming Rosen as a co-conspirator in the case of Stephen Jin-Woo Kim, whom the government has accused of leaking sensitive information.

Rosen has not been charged, but by naming him as a possible co-conspirator in the case, the Justice Department was able to secretly obtain access to his private emails. Fox News has reported that Rosen’s parents’ home phone records were seized as well. And though Holder has claimed he has recused himself from the investigation in the seizure of the AP’s phone records, his fingerprints on the Fox News scandal are indelible if the NBC report is true.
