Rep. Jerrold Nadler took to the House floor Tuesday to talk about marriage equality and suggested that same-sex and interracial marriage were probably next to be overturned now that Roe v. Wade has finally fallen. Nadler noted that Justice Clarence Thomas didn’t mention the Loving decision in his Dobbs concurrence maybe because he’s intermarried, and so is Sen. Mitch McConnell. Maybe that had something to do with it.

Or… maybe it's because Loving v. Virginia was decided upon a totally different constitutional basis than right to privacy cases like Roe, and isn't in any danger of being overruled. Are we to believe that Nadler, an attorney, doesn't understand that distinction?

He didn’t mention Loving because Loving wasn’t decided with substantive due process. It was an equal protection case. His gripe is that substantive due process isn’t a real protection and any case decided in that way needs to be reevaluated.
