Yeah, there’s a difference between “innocent” and “guilty”.
I’m cautiously pro-death penalty in the absolute worse of cases where certain very strict conditions should be met.
Even so, the distinction should take less then a moment to work out.

It goes like this: the unborn did not have a choice in being conceived. The ones serving for a life sentence or capital punishment, had that choice and was represented by a defense. Notice the word “choice”. All a matter of free will!
