Today President Biden formally announced the retirement of Supreme Court Justice Stephen Breyer. During the announcement, which featured a failed presidential attempt at humor, Biden made it clear that his nominee to replace Breyer would indeed be judged by the color of her skin.

At the end of the announcement, Biden was eager to answer reporters’ questions. Wait, no he wasn’t, as that would be “inappropriate” or something:

You’ll also notice that Biden handed Breyer his mask and then walked away maskless as Breyer put Biden’s mask in his pocket. Is this some sort of weird new CDC guideline? Probably not.

Biden said taking questions would be inappropriate with Breyer standing behind him, so we expect that Biden might ask Breyer to stand behind him more often.
