In the wake of this morning’s Hobby Lobby ruling, Sen. Kay Hagan, D-N.C., suggests that access to contraception is now “up for debate.” Either Sen. Hagan is deliberately lying or she has no understanding whatsoever of this morning’s ruling.

We suspect the latter.

    I mean, you went to law school in the 70’s– it was still a pretty fresh opinion then, and said that access to contraception could NOT be prohibited by “Comstock” laws. (“Ol’ Grizzy” is the famous “emanations-of-penumbras” case, if that helps.)

    Um, Kay…if 99% of women will use contraception, how does that comport with the definition and practical application of the insurance model?

    the point of insurance is to spread out the cost of an unusual or unlikely event that would be catastrophically costly in nature, over a wide population through the cost of premiums that don’t guarantee any return on the investment. Contraception fails on all three points:
    -If 99% of women will use it, it no longer is unusual or unlikely
    -Birth control is not at all expensive, except for rare cases when a person can only use very specific methods
    -If 99% of woman will use it, and get it covered by insurance, it’s pretty much a guarantee that they will see a return on the investment of their premiums

    So if the insurance companies KNOW that it will be used, they will theoretically (and in practice) up their rates to cover it.
