A Houston waiter was an instant hit on Twitter after news surfaced that he refused to serve a restaurant patron he says insulted this adorable five-year-old boy with Down syndrome.

Milo and his family were eating at Laurenzo’s restaurant in Houston this week when the group at an adjacent booth moved to another table.

Waiter Michael Garcia overheard someone say, “Special needs children need to be special somewhere else.” His response to the asshat customer? “I’m sorry, I can’t serve you.”

Tweets of appreciation and support are pouring in for Garcia and the restaurant.

Applause for Garcia is also flooding the restaurant’s Facebook page, and even people outside Houston are hoping they’ll get the chance to visit Laurenzo’s someday.

And yet here on Twitchy, you all applaud a restaurant that refused to serve gay couples. Hypocrites.

    • WilliamAmos

Making things up again are we Michael ?

      • http://twitter.com/hamybear Michael Hampton

No. Do I need to quote people? “Gay’s are trying to make it so that it is illegal for me to refuse to support their lifestyle” “It’s infringing on my religious freedom if I have to serve gay people” “Obama is making it illegal for me to refuse to condone a perverted lifestyle by having them in my business”

        • WilliamAmos

Show me where someone on the twitchy staff said these things. You said all people say that. That makes your statement false. And I delete comments that attack others on here so know that while some comments slip through the cracks not everyone here is out to get you. Speak your mind on political issues. You tend to drag your personal feelings into too many posts.

          • dwsmokin

Well said. By his reasoning, if one conservative says it-all conservatives think it. That’s part of the problem

          • WilliamAmos

You are making things up. Michelle is talking about anti Christian bigotry on the left. You seem to argue that its alright to be a bigot if it agrees with your point of view.

          • http://twitter.com/hamybear Michael Hampton

No. I am not. People can read it for themselves and see for themselves that Malkin wants businesses to be able to discriminate against gay people.

          • http://www.facebook.com/profile.php?id=100002109532283 Jillane Kent

Your reading comprehension is abysmal if you believe that the Chick-Fil-A story was about a company’s right to refuse service to homosexual patrons. The company, in fact, has a non discrimination policy and complies with all laws by extending benefits to domestic partners in State’s that mandate such benefits. The Chick-Fil-A quibble was over the right of a CEO to express an opinion-an opinion that was held for many years by both our President and Vice President-without fear of rebuke and terroristic threats. I challenge you to find a story (credible newspaper, please, as this would have made national headlines) that shows discrimination against a couple for no other reason than being gay. Furthermore, how did the scoundrels of the eatery know this couple were gay? Gay individuals that I know do not advertise their sexuality nor wear it on their sleeve like a needless scarlet letter, so I am especially interested to see your explanation.

          • http://twitter.com/hamybear Michael Hampton
          • dtcsd

Thats not true, People could disagree with a gay lifestyle that doesnt mean they would strip them of their human rights. Dont do that.

          • http://twitter.com/hamybear Michael Hampton

            And yet they do.

          • Richard Sturms

Oh I know what is it now.you think the worship of Jesus Christ, the Bible and those who still believe in a moral standard in which right is right and wrong is wrong, which is waht the homosexual act is: MORALLY WRONG,is criminal and those who believe in Christ should be removed from America. That sum it up your stance?

          • http://twitter.com/hamybear Michael Hampton

Not at all. You can hate me all you want. You just can’t discriminate against me. I get the same rights you do. As I have said many times, my marriage has absolutely NOTHING to do with your religion.

          • http://twitter.com/hamybear Michael Hampton

Here is the owner of Twitchy saying it. Is that enough?

        • cfc1905

While I wouldn’t support a business that discriminated against a person for being gay, I also don’t support people that openly flaunt their sexuality be it gay or straight. Gay people who act ridiculous in public deserve to be discriminated against, same as straight people. People may not choose to be gay, but they should be held responsible for the way they act in public. Shame was banished during the Clinton administration, it’s high time we brought it back…

      • http://twitter.com/hamybear Michael Hampton

How is that previous comment not a personal attack?

    • Joseph Phillips

Once again, “It’s all about me and my little hurt feelings.” No wonder Libs love Obama – he sets the standard for self-absorption.

      • http://twitter.com/hamybear Michael Hampton

I never mentioned myself. I actually only mentioned the hypocrisy of people like you. Please try to keep up.

        • Joseph Phillips

Michael – you’re gay. You made the story about you, gay people, and people here on Twitchy – first comment. For the record, I’m Libertarian and think adults should be able to marry whomever they’re in love with (not that I need to explain my beliefs to you). I didn’t applaud any restaurants not serving a gay couple.

          • http://twitter.com/hamybear Michael Hampton

I appreciate your clarification. My intent was to point out the hypocrisy of those that believe discrimination is somehow related to their “religious freedom” There was a story recently where a lesbian couple ate at a restaurant in Illinois and the owner walked up to them, asked them if they went to church, and then handed them a not condemning them and asking them to quietly leave and never come back. I felt that this story and that one had a lot of similarity. And thank you for your support of marriage equality.

          • Joseph Phillips

Michael, no problem. I think we can agree that there are rude, obnoxious people on both sides of the aisle. I may not agree with your beliefs and philosophies, or you with mine, but I think maybe you and I could start something in the way we treat each other and our fellow Americans. Just because people are rude to us doesn’t mean we have to be the same to them. I’ve seen your posts around here and it makes me, and others, think you’re just looking for a fight. I too throw out some zingers, but you and I might engage each other more with some calm, rational discussion rather than insults. Best to you…

          • http://twitter.com/hamybear Michael Hampton

And to you as well. Thank you. I just am so used to (as you can see if you read the other responses to me) defending myself with as much bitterness as I get. It has become my go to. I will certainly try to practice what I preach in treating everyone the way I would like to be treated.

          • Joe

So, Michael Hampton, by comparing the plight of discrimination against gays with this story of a downs syndrome child facing discrimination, are you saying that gays are developmentally challenged as well? If not, then this is apples and oranges.

          • Richard Sturms

I not aware that religous freedom is a fake thing to be put into quotations,or illegal in America. If you hate people of faith so much, please go to the local mosque with as much hate as you show towards the others.perhaps people will believe you then

Joseph, hamybear – to whom you responded – refers to himself as “one in a million, and better than most.” This from an under-employed realtor and actor. So – yes – he is ego-centric, as much as your average three-year-old.

I feel the same way about the issue of gay marriage. I believe that every citizen in this country should have access to any service the government offers. To me this is not really a moral issue as the government should not provide a civil union certificate to some people and not others. We as citizens should not support our government determining which citzens they will serve. Gay people pay taxes and they should not be descriminated against. This is a civil rights issue.

          • Matthew T. Mason

This is not about “g-y” marriage. Please go somewhere else if you wish to discuss it.

        • Adela Wagner

I am a bisexual proud conservative Libertarian. I was Advertising
Director for Our Own Community Press for years. (hard to lump me in
anywhere) I believe ALL people have the right to pursue happiness as
long as it does not infringe on another’s rights. I would never applaud
any person nor restaurant refusing service to anyone who was not being
disruptive to their other customers. So as I am sure you do not like
being “lumped in”, please do not think for a moment the people here on
Twitchy are all cut from the same cloth. And in fact, I like most of the
people here, so please try to keep up.

          • Joseph Phillips

            Rock on, Adela!

        • Matthew T. Mason

Dude, really. This story has absolutely nothing to do with same-sex couples, and yet here you are, trying to hijack the forum with your exercise in self-absorption.
Allow me to make things abundantly clear: This world doesn’t revolve around you and whom you sleep with. Put on your big boy pants and grow up!

    • ChampionCapua

Don’t recall doing this, don’t recall hearing about such a restaurant…and since you said “you all applaud” you obviously mean me. Which makes you a liar. Hypocrite.

Way off base Hoss. Perhaps a few applauded, but not most of us. Perhaps you should pay a bit more attention. My conservative city has a gay mayor who’s done a great job-we’ll vote him in again. NOT because he’s gay-but because he’s good. Lighten up.

          • http://twitter.com/hamybear Michael Hampton

I apologize that you don’t like to hear dissenting viewpoints. And that you find free speech annoying.

          • Jack Deth

Own up to your criticism as a man and stop playing the victim.

Your non apology apology is incredibly weak, lame, pitiful and not accepted.

          • WilliamAmos

OK you had your say Mike. Enough. Any further comment by you on this thread gets deleted. I have been tolerant but you keep pushing things.

            Thank you Mr. Moderator.

          • http://twitter.com/hamybear Michael Hampton

Aww. So you allow someone to make an extremely personal attack that has absolutely nothing to do with the topics being discussed as long as it is against me and then tell me that you delete all personal attacks. Then you tell me that I am not allowed to post anymore and respond to the attacks levied against me. How sweet. Thank you for proving what a mouthpiece you are for one conservative viewpoint. Now go beat your wife.

          • Matthew T. Mason

In case you haven’t noticed, moron, this is a conservative website. It doesn’t exist so lonely d-bags like yourself can come in and troll. For you to actually portray yourself as a victim after you deliberately make a comment that has absolutely nothing to do with the story (“Houston waiter refuses to serve man who reportedly insulted child with Down syndrome”) is indicative of your malicious intent.
No, you shouldn’t be allowed to defend yourself when you get attacked in response to a troll. Fortunately for you, though, the mod can only delete your posts. Places like FreeRepublic, there wouldn’t be a second post because you’d get the zot right after the first.

          • 1azuce

No attack intended Hampton. It was a serious question about the article and the link. Never saw the story nor would I applaud it, as you claim.

I apologize. Again, as you can see, even the moderator doesn’t want any dissenting opinions posted.

            Thanks for the link Hampton.

          • wwbdinct

Last week a poster on another thread made a claim that social conservatives have veered toward violence and murder. I asked that poster to back up that claim with proof (which, BTW, he never did). You chimed in with a story about the Luby’s cateria massacre in Texas back in the 90’s. You claimed that the reason that man went on his rampage was because Clinton had enacted DADT – you said those words came right out of the shooters mouth. I responded to you that the massacre happened while Bush was still president (the election hadn’t even been held when that happened) and that they didn’t have a real motive as to why he did that because he killed himself that day. But they thought it might have had something to do with his hatred for “white women”. So you see Michael, you do make things up – you lie to suit your agenda. You don’t put links up because you don’t have real PROOF to back up your assumptions. You forever play the gay victim card here and what is particularly gross about your comments on this story is that it had absolutely nothing to do with being gay but everything to do with a 5 yr old Down’s syndrome child. Your narcissism would not permit you to just simply post support for the waiter in this story and for the 5 yr old. Nope – it had to be all about your persecution complex.

          • http://twitter.com/hamybear Michael Hampton

The location of the shooting, I had gotten wrong. I admitted that. And every time that I have put up links to stories, people here tell me that the site I posted from is “a liberal lame-stream media” site and that they would never trust anything from it. That is why I said that it is better for you to search yourself. That way you can find the story on a website that you will find credible.

I am sorry that my comment wasn’t directly about the “article” here, but seeing all of you gladhand each other with this story when conservatives keep telling me that they want to be able to discriminate against gay people reminded me of that story with the two women being discriminated against openly by a restaurant. I wanted to see if the same outrage would be present. Of course it wasn’t. I didn’t realize that I had to comment only about conservative topics. I thought I had the ability to exercise my right to free speech and talk about anything that the “article” reminded me of. With the level of personal attacks that have been levied at me, your insults really don’t bother me. Insult away. It doesn’t change the fact that I was right about this story, and I was right about the shooter in North Carolina.

Here is a link to the story about the discrimination of the restaurant against the young women.

            http://www.wcti12.com/news/Lesbian-couple-Restaurant-owner-hands-them-letter-condemning-homosexuality/-/13530444/18086232/-/n0mfvd/-/index.html

I applaud anyone who refuses to let others tell them who they should do stuff for.

I have no rights to their services.
if they do not want my business good for them. I have no need for them then.
so get over the butt hurt.

      • Adela Wagner

A true Libertarian dm. While I think it was brave for this waiter to stand tall and the right thing to do, I also believe that an owner of any private business should be able to run that business as they see fit. If people think they are terrible, then the market will or will not bear it out. Obviously this is a GREAT restaurant and I do applaud them.

I agree. thats the way it should be.
the flip side is any business that did this would probably soon go out of business due to limiting its market base.
and thats the way it should happen.
no “too big to fail” crap either.

          • http://twitter.com/hamybear Michael Hampton

So think that this waiter should have kept their mouth shut then and allowed the patron to continue to say terrible things about this defenseless child. How sweet.

            again with the butt hurt.
and as I said in another comment I don’t know the full story so I am not commenting in if the waiter was right or wrong.

            so who’s discriminating?
            butt hurt drama queen…..

And the conservative protesters outside of General Mills, when they supported marriage equality, claimed that the manager spit on them when in reality he came out and offered them food and drinks.

Sounds like you might be calling gayness a disability. ???
And, gosh, was that gay couple 5 years old?
A restaurant refusing to serve a gay couple is wrong.

it just seems odd those patrons would do that with no preceding items happening.
but I don’t know, wasn’t there, so am not qualified to say anything else.

  • BeeKaaay

Meanwhile leftwingwackos would be telling the parents that this kid is better off dead.

    Bloodthirsty. They are.

  • raldy

Thank goodness it wasn’t one of Palin’s kids!

  • clocker1

Had to be a liberal making remarks about the kid. They hate everyone.

  • http://www.facebook.com/sam.cairo.1 Sam Cairo

I don’t know why you keep trying. You cite facts and examples, but are just slandered in return. This is just a right wing echo chamber. There are better sites where you can actually discuss issues calmly. With this site, even the moderators are vicious. They let the right wingers spew hate, but then call you a liar because they misread your comment.

    • http://twitter.com/momraising5boyz Lynne Tuck

So why don’t you go there????

  • Johnny Blade

I think this whole story just serves to illustrate how shallow and lacking in substance our society has become. Without any real facts concerning the event people are lining up to climb on their high horse. Assholes should be able enjoy an event they are paying for just like anyone else.. I am willing to bet that little boy didn’t even notice the guy. The thin skin chorus is getting tiresome.

  • Daria DiGiovanni

God bless him for standing up for that precious child and his family! Nice to know there are still decent people with the courage to stand up for others.

  • J.N. Ashby

I hope his boss was of the same opinion on not serving that guy.

  • http://www.facebook.com/mactink Athena MacDonald

I totally support that customers right tonfeee speech… somewhere else. what a prick.

    • orringtonmom (D)

some free speech needs to be inside thoughts.

  • Darrell G. Walton

He may of said something not cooth that was overheard by a waiter, but not directly at the Downs child. He did not impede the child from patronage at the restaurant.

Once again political correctness sets the wrong standard. Bleeding hearts lead to broke businesses.

    • https://twitter.com/QuantumFlux1964 Quantum Flux

About 25 years ago, I was an Asst Manager of a Hardee’s. One night when we were extraordinarily busy, a couple of guys made a point of changing cashier lines to mine because they didn’t “want to be served by a n**gger”. After several minutes, they finally got to the counter, and I refused to serve them because I overheard their insult to my employees.

According to your logic, I *should* have served them because they didn’t impede anyone and didn’t say it to Elaine’s or Mary’s faces. Do you know how stupid that sounds?

      • Darrell G. Walton

Do you know how naive and damaging to a business not knowing the law is. The fact they didn’t say it to your employees faces, it didn’t incite any physical and mental duress to your employees or the public around. Beliefs and opinions arent illegal. If though the rude customers have a clear legal remedy they could pursue, most dont as the petty situation doesnt merit the enormous time and expense to make it worth it. It would be hard to find an attorney who would want to advocate for their stupidity. Also it would be character assasination on a much bigger forum for the rude customers as well. That’s what’s in the waiter’s favor as to not be called on hiss actions.

        • https://twitter.com/QuantumFlux1964 Quantum Flux

All restaurants have the right to refuse service to anyone. What I did wasn’t illegal. And how do you know those bigots didn’t cause any mental duress? The employees heard it. Plenty of others did too.

Sure those guys are entitled to their opinions. However, they aren’t entitled to use my restaurant as their forum to share it.

  • sqeptiq

Bet the party who dehumanized the Down’s kid were white Republicans.

    • BeeKaaay

Not really, they were likely to be democrats, since they want Downs Syndrome kids killed through abortion.

      • http://twitter.com/hamybear Michael Hampton

Can you show me where that was in the democratic platform? Link please.

        • Matthew T. Mason

          Really?

        • BeeKaaay

Yes. It is the pro-abortion plank. They not only want downs syndrome kids dead, they want other kids dead as well.

It is the 100% leftwingwacko approved of killing children, which is ripping apart children from limb from limb. Leftwingwackos condemn shootings at schools because children die in a less painful method than their 100% approved method.

          Leftwingwackos are bloodthirsty.

    • http://cowboybebop.wikia.com/wiki/Faye_Valentine Faye Valentine

I doubt it, considering pro-abortion Democrats are responsible for helping the 99% abortion rate of Downs children after prenatal testing.

  • marjoriemck

Amazed that the first seven posts I read were all about liberals being evil. When I read this article, I saw nothing indicating that any participant announced his or her political affiliation. I don’t know why some nutcases want to insert their politics here, but as a liberal, I would never insult a child. And my brother, as a conservative, would also never insult the child. Those of you posting otherwise… go back to kindergarten with your childish antics.

  • Martha Sparkman

Remember: The Left has accused Conservatives of wanting to deny special needs children health care, schooling, etc., but THEY are the ones who want them all aborted! We actually take care of our own. They (Obama) think that having one of these kids would be ‘punishment’. Kudos to the waiter!

    • lanza0613

ok you’re seriously misinterpreting what the left stands for. We simply want women to have the right to chose. That’s it.

    • http://twitter.com/hamybear Michael Hampton

No one is putting forth legislation to abort special needs children. That is a lie.

      • Evil Otto

Martha did not use the word “legislation” in her comment.

      • Matthew T. Mason

And nobody said that. Try again.

      • BeeKaaay

They don’t have to put forth legislation to abort special needs children.

Leftwingwackos, as soon as a pregnant mother finds out their kids is diagnosed with downs syndrome, immediately put forward the pressure program of “abort the kid”

Even though the tests are not 100% accurate.

My son was diagnosed with down’s in the womb, and we got non-stop propagandizing at the leftwingwacko dominated government run hospital, to kill the little guy, at each prenatal appointment until he was born. When he was born, he didn’t have one smidgen of Down’s. The test had false results.

It is the leftwingwackos who think that children have no value. President Moloch says they are a punishment. This is why he seeks to push the pro-slaughter agenda.

  • docscience

wonderful waiter…the boy is adorable, and looks like a loved and happy little boy! how could you not like him? guy was just a bigot.

  • https://twitter.com/davidjkramer DavidKramer

Was it Andrew Sullivan by the way?

  • Mike Kuzan

Love this man, Michael Garcia- you are awesome!!!

  • Guest

Good for him! And for everyone turning this into a political argument…just please shut up. This has nothing to do with left or right, liberal or conservative, but how a kind person, REGARDLESS of his political views, stood up to one of the many rude, ignorant people in the world. Good luck to little Milo in everything he does!

  • George Murrey

Who are we to judge others that are different than us? I applaud Michael for standing up and letting the little guy know it. I bet management will give this waiter a big thank you and will let others know how great Michael is. How about a special bonus for standing up for his beliefs?

  • http://www.facebook.com/darius.leitch Darius Leitch

good job…that guy should have left if he didn’t like it

  • Lloyd Revalee

Special needs children, and adults, need just that. Special care and consideration. I recall a time when one little tyke with Downs Syndrome crowed our little son out of a game he was playing on an electronic device, and just took over. We let it go, and took the time to explain to our Son why he was doing a good thing in letting the boy do what he did. No one was harmed by this little incident, the special needs little boy had fun, and our Son was able ot go on and play another game.

AWSOME JOB. Everyone deserves respect espescially a child, because every child is special no matter how God made them.

  • Darrell G. Walton

I’ve gotten so many replies from my previous comment that I’m resigning from this dialogue.

My final comment is there are so many on here that are naive of the basics of Constitutional and business law that they’re live very vulnerable lives to be subjected to other people’s equal rights and protections under those laws. You cannot deny or discriminate services for one’s beliefs you don’t agree with unless they act upon those beliefs by directly inciting a mental or physical injury or impedence upon an individual or the public.

Fortunately for cases like these as for the pettiness of them such as the waiter actions they are almost never pusued or litigated as the rude person isn’t going to invest the enormous time or expense to be right. Also there is much in the way of attorneys that would want to stake their name and reputation for such an rude individual.

We may get mad and angry for the alleged hurtful things one may say as to want to do something about it. But fortunately our emotions don’t supersede everybody’s protections under the law. That’s what freedom is about. Sometimes you have to bite your tongue as someone may have to bite theirs when you say something in all due respect.

    • BeeKaaay

Unfortunately, leftwingwackos don’t believe in human rights for all, they only believe in human rights only for the chosen.

  • emerson1248

Wouldn’t you know they were a table of Obama supporters coming from his local inaugural party for the elite leftists. What a bunch of low life snobs…

  • emerson1248

thats why they are pro-abortion, so they don’t have to see kids like him.Scum bag’s

  • sherie grant

While I think it’s subhuman to insult the poor kid publicly like that, doesn’t the waiter show discrimination towards those with whom he disagrees? What if the idiot was spouting off on politics, homos’, etc.? Doesn’t he open himself up to a discrimination suit? Just wondering.

  • http://twitter.com/buellafoghorn stephanie nowadzky

my daughter has down syndrome. she is beautiful, amazing, loving & highly intelligent…thanks u to the waiter for being able to see past someone features & appreciate that we all deserve life….the dude that had something to say??? come on to des moines, i’ll pay u to insult my kid in front of my husband, i might be out some cash, but it’ll be worth it to see a hateful waste of LIFE get it’s worthless ass handed back to him.

  • Kathy Walsh

I wish more people would stand up for what is right. Good Karma will be coming your way.

  • http://www.facebook.com/people/Tom-Davidson/100001252792101 Tom Davidson

My grandmother never tolerated rude behaviour, and raised her children and grandchildren the same way. Thank you, Michael, for renewing my faith that civility has not been extinguished by the ‘tolerance’ of the Left.
Being a Hero means doing the right thing, and sometimes than means being Intolerant.
