      I have often cited “Monty Python and the Holy Grail” in explaining how spanking can take on sexual overtones. But less comically, it stands to reason that since there are people out there who are sexually drawn to children, some would enjoy spanking them.

      The tragedy for many victims is that society has mostly failed to recognize the potential for sexual abuse in the practice of spanking children or even young adults. Perpetrators often deflect suspicion simply by playing the discipline card.

          MASON – A judge on Thursday acquitted a middle-aged psychologist of an assault charge for pulling down a 14-year-old girl’s pants and spanking her hard enough to cause bruises.

          The prosecutor and children’s advocates expressed surprise at the decision in a corporal punishment case that raised questions about how far a nonparent can go in disciplining another person’s child.

          Gary Freudenthal, 49, of Blue Ash, testified Thursday that he thought he had permission from previous conversations with the girl’s grandmother – her legal guardian – to discipline the child, who was a friend of his daughter.

          On Aug. 31, Mr. Freudenthal, a single father, said he was upset because the girl was picked up by police the night before on drug and curfew violations when she was supposed to be spending the night at his house after attending a football game with his daughter.

          So, he went to the grandmother’s Mason home about 9:30 a.m.walked into the girl’s bedroom after asking the grandmother where she was, took the girl out of bed, placed her over his knee and spanked her.

          When the girl laughed, Mr. Freudenthal said he pulled her bikini bottoms down and administered another spanking. A police officer testified that the spanking caused bruising on the girls’ upper legs and buttocks.

          “I spanked her hard enough so she could feel it … so it would sting, so she wouldn’t be able to sit down, so she would remember it,” Mr. Freudenthal testified. “She was so out of control.”

          He said he hugged the girl after the spanking and told her, “I’m sorry it has come to this, but I want you to live.”

          The girl’s grandmother said she did not give Mr. Freudenthal permission to strike the child, although she had discussed her granddaughter’s discipline problems with Mr. Freudenthal.

          City Prosecutor Robert Peeler told Judge George Parker that the issue was clear-cut: “Did he commit an act where he caused or attempted to cause physical harm?” to the teen, which are the elements of a misdemeanor assault charge.

          “This case was about whether a 49-year-old man has the right to go into someone else’s house and pull down the pants of the 14 year-old girl and strike her,” Mr. Peeler said after Judge Parker issued his verdict.

          “It was undisputed there was physical harm. My position was that under any set of circumstances, (Mr. Freudenthal) crossed the line.”

          Judge Parker alluded to a police report that included comments from the girl’s grandmother that the spanking was “appropriate.” The grandmother denied that statement from the witness stand.

          Mr. Freudenthal said he was relieved by the verdict and insisted that he did nothing wrong.

          “I was trying so hard to be there for this kid,” he said, adding that he felt he was acting in a parental capacity that day. “Parents should be free to do what is in their best perception to control their children.”

          Yvette McGee Brown, president of the Center for Child and Family Advocacy in Columbus and a former domestic relations and juvenile judge in Franklin County, said she was puzzled by the verdict, given the circumstances of the case.

          “It sounds like assault. There is no authority I’m aware of that gives someone who is not the parent the right to spank or hit the child,” she said.

          However, if consent was clearly given, a judge or jury could lean toward acquitting the defendant, she said.

          “You can’t hit a neighbor’s dog, so what was he doing hitting a teen-age girl?” said Nadine A. Block, executive director of the Center for Effective Discipline, a Columbus-based national organization that opposes corporal punishment.

One of the students, an 8-year-old boy, was singled out by DiPalma. The boy was given a sticky note and told to make a checkmark on it every time he didn’t follow DiPalma’s instructions. The boy was told he would receive a spanking for each check mark. On July 27, 2006, when the other children were on lunch break, DiPalma lured the boy to his car and put him into the back seat. DiPalma then drove to the parking lot of a nearby apartment complex then climbed into the back seat with the boy. He put the boy on his lap, pulled down his pants and spanked him 20 times on his bare buttocks. The spanking left marks and DiPalma told him not to tell or that he would go to the boy’s house and spank him harder. When the boy’s mother picked him up at the end of the day, he told her what had happened. The family reported the incident to the Lakewood Police Department.

        DiPalma’s case went trial in September, 2006 but the jurors were unable to reach a unanimous verdict.

        The jury heard evidence that in May 2006 DiPalma had worked for a company called “Computer Tots’, teaching an after-school class at Steck Elementary School in Denver. In that class he asked the second graders to vote on which of them should be spanked. He spanked at least two 7-year-olds before his employment at Steck Elementary was terminated.

        Court records also indicate that DiPalma had been accused of unlawful sexual contact of a child, kidnapping, and false imprisonment in 1999 in New Mexico. The boy and girl who were named as victims in that case were 10-year-olds and they did not know DiPalma. He was given a deferred judgment and probation.

        DiPalma was remanded to the custody of the Sheriff following the sentencing. He will be required to register as a sex offender.

            now he was going to let her pick one of two choices for
            a punishment: either he would tell her parents and
            teachers what she had done and take away certain
            privileges, such as recess and gym; or she could take off
            her pants and panties and let him spank her as he would
            his own child, and no one need ever know what had
            happened.

            “Can’t I leave my underwear on?” asked Amanda. No, she
            vividly remembers Wadsworth telling her, embarrassment
            is part of the punishment.

            Amanda, a feisty child, knew she shouldn’t have to
            remove her clothes. She didn’t like either punishment,
            she told him, defiantly. Perhaps taken aback by someone
            willing to stand up to him, Wadsworth told her to leave
            his office and never again brought up the incident.

            Amanda’s friend chose the spanking.

            Wadsworth has pleaded guilty to possession of child
            pornography – pictures and videos of children being
            spanked – as well as to sexual assault and gross
            indecency against eight former students at a Pincourt
            elementary school. Amanda Green, now a Concordia
            University student, finds herself haunted by how many
            other children might have chosen to be spanked on a
            bare bottom by a man everyone believed was a
            sweetheart principal and a terrific teacher.

        At a minimum, spanking as a disciplinary option in the workplace constitutes sexual harassment–including where minors get jobs years ahead of graduating and no longer being fair game (in 19 states) for spanking by a teacher at school. It’s really such a crazy mixed message.

      Michael David DiPalma appeared today in Jefferson County Court and was sentenced to Intensive Supervision Sex Offender Probation for a period of ten years to life and two years in the county jail. The 33-year-old former day camp teacher pled guilty on January 25 to Sexual Assault of a Child, a class four felony.

      Michael DiPalma, who now lives in Centennial, worked at a Lakewood recreation center teaching Elementary Engineering Using Lego and Elementary Robotics Using Lego in July 2006. One of the students, an 8-year-old boy, was singled out by DiPalma. The boy was given a sticky note and told to make a checkmark on it every time he didn’t follow DiPalma’s instructions. The boy was told he would receive a spanking for each check mark. On July 27, 2006, when the other children were on lunch break, DiPalma lured the boy to his car and put him into the back seat. DiPalma then drove to the parking lot of a nearby apartment complex then climbed into the back seat with the boy. He put the boy on his lap, pulled down his pants and spanked him 20 times on his bare buttocks. The spanking left marks and DiPalma told him not to tell or that he would go to the boy’s house and spank him harder. When the boy’s mother picked him up at the end of the day, he told her what had happened. The family reported the incident to the Lakewood Police Department.

      DiPalma’s case went trial in September, 2006 but the jurors were unable to reach a unanimous verdict.

      The jury heard evidence that in May 2006 DiPalma had worked for a company called “Computer Tots’, teaching an after-school class at Steck Elementary School in Denver. In that class he asked the second graders to vote on which of them should be spanked. He spanked at least two 7-year-olds before his employment at Steck Elementary was terminated.

      Court records also indicate that DiPalma had been accused of unlawful sexual contact of a child, kidnapping, and false imprisonment in 1999 in New Mexico. The boy and girl who were named as victims in that case were 10-year-olds and they did not know DiPalma. He was given a deferred judgment and probation.

      DiPalma was remanded to the custody of the Sheriff following the sentencing. He will be required to register as a sex offender.

      Actually is wasn’t so much Cruz using his kids that was criticized, but some racist, bigoted liberal cartoonist portraying them as monkeys.
      If there’s one thing we’ve all been taught by the Leftists in the last 8 years, it’s that portraying anyone who is not 100% white European as a simian is flat out racist.

        That’s true about the cartoonist coming under fire (and the Washington Post even withdrawing the cartoon). However, that doesn’t invalidate the criticism of Cruz for putting a spotlight on his kids to begin with.

        Even if it doesn’t harm children per se to be used as shills–I’m thinking of the local car dealership or mattress store ads that feature some cute child touting the unbelievable rebates his or her dad is offering–there’s something kind of tacky about it. But at least there the exposure is limited and the message uncontroversial. Not so much with a presidential campaign ad.

    I taught emotionally disturbed/behavior disordered middle and high school kids for 17 years. The vast majority suffered from a major leather defiency. A little parental discipline would have cured most of their issues.

      It’s funny that you mention leather, in any case. The Florida deputy Robin Pagoria, now serving a long jail sentence, used a paddle made of leather to punish her daughters (as well as a “spanking bench”). People seemed to find it more sinister that she used a leather paddle versus a wooden paddle. What do you make of that?

    Well it’s been awhile since anyone last heard from Wesley Crusher. Though strangely enough in this instance, I don’t think he’s necessarily wrong. I don’t think spanking is a good resolve to punishing bad behavior, though it’s ultimately up to the parents what they think is the best course of action. And Hillary badly needs a good spanking for her serial lying.

That is what is wrong with society today, kids have no boundaries or consequences and don’t tell me “time out” works, that’s just plain nuts.     You know, I don’t have kids, but my folks spanked me when I misbehaved, not as a way to instill fear, but a way to show actions have consequences, and quite frequently, bad actions have unpleasant consequences. If I decide to ignore when an LEO tells me to show my hands after I was taking something that doesn’t belong to me, I daresay I’m gonna get something a bit worse than a spanking, and far more lasting. These people clearly don’t understand the purpose of corporeal punishment, nor how it functions. Instead, they’d rather listen to the opinions of individuals that, quite frequently, lean left and don’t have children of their own. The historical facts alone are enough to disprove their ‘studies’.

      Thank you. You get it. Physical discipline (spanking) is all about teaching consequence for action. Every last one of us has a problem with understanding consequence for action when we are young. If that’s not corrected before we do something really stupid, we could very well end up dead, crippled for life, or wrecking the lives of others.
