The dismantling begins: Senate votes to repeal Obamacare’s medical device tax

We guess the “severe conservatives” among the Senate Democrats and Republicans didn’t get @BarackObama’s memo reminding them of the futility of trying to roll back progress. The Supreme Court may have upheld Obamacare, but the court doesn’t control the purse strings.

Yes, most of us are still finding out to our shock and surprise what’s in the Affordable Care Act, but in a non-binding resolution tonight, the Senate voted 79-20 in favor of repealing Obamacare’s medical device tax, which was calculated to raise $20 billion over the next 10 years to (help) fund it.

Update: More senators are beginning to weigh in on the vote.

Cabela’s cash register ‘glitch’ shines spotlight on new medical device excise tax

  • V the K

Hmm. Democrats are always claiming that taxes have no impact on business; yet they voted to repeal the medical device tax because it was hurting medical device companies.

    What am I missing here?

      The cluelessness of the Faithful?

I know many people who are doctors, nurses, PAs, & NPs in the oncology/hematology side of the medical field – ***and I have not read it with my own eyes, so I am NOT quoting*** – but they all say the dialogue in Obamacare concerning cancer and the treatment thereof reads something like this: No matter your age, if you are insured under OCare and are treated for cancer and the cancer returns, you can only be treated ONE MORE TIME. It is apparently a 3 strikes and you’re out rule. For example, if you are a 4 year old with leukemia and are treated with chemo, etc and the leukemia goes into remission and comes back when you are 9, you can only be treated once more. If the cancer returns…. say when you are 15…..OCare will NOT pay for you to be treated again. I feel certain since I have been told this by many people in the medical community, it is probably true. UGH! Sickens me. If any readers know differently, please share.

You’re hearing the same dumb rumor over and over. If it’s not on paper, it’s not true.

      Who MAKES those devices?

      • Scott Anderson

        Democrat donors? I’m guessing.

      • Gallatin

Warsaw, Indiana is home to Biomet, Depuy, and Zimmer plus numerous suppliers. My former senator, the ass clown evan bayh voted for the “affordable care act”. Then after “retiring” from office he went to work for the very same device manufacturers. bayh then had the gall to write the following opinion piece in the Wall Street Journal, – Opinion: Evan Bayh: ObamaCare’s Tax Raid on Medical Devices*.

In the first sentence bayh washes his hands of any responsibility for the act by blaming the Supreme Court for not overturning it.
Bayh was one of 60 Senate votes needed for obamacare to pass, he could have stopped it. Now he goes around and whines about one of the consequences of it. He is a perfect example of what is wrong in Washington and both parties are guilty of it.

elizabeth “fauxcahontas” warren also wants to repeal the tax because it hurts Massachusetts.

These people are just stunning in their hypocrisy.

        • ceemack

Hypocrisy by itself can’t explain the whole thing. You have to mix in a healthy dose of stupidity.

    • Scott Anderson

Cognitive dissonance, it’s what the left eat for dinner.

  • Mark Seavey

Senate didn’t actually vote to repeal the tax. It was a non-biding budget framework, so Obama won’t be signing it.

    • arttie

      Political posturing and preening.

      • PatriotLady77

EXACTLY!!!!! They know that 2014 is just right around the corner. They are also beginning to hear that THE AMERICAN PEOPLE ARE PISSED AS HELL!!!! “I think it’s time to CLEAN HOUSE in Congress”! Too many “career politicians & power hungry whores on Capitol Hill

It doesn’t matter which Party, or persons, supported Obamacare. What’s important is that it is BAD LAW and should never go into effect! If Congress members and their families, and HUNDREDS of Democrat-friendly companies and Unions, got “exempted” from it, then something is terribly wrong. They don’t pass up on beneficial programs! Repeal it before the cost of implementation alone eats us alive. Sometimes bad law gets wrote, and you just have to have enough sense to see that and repeal it.

  • kim

I’m sure the donors that manufacture medical devices is now happy. should have left it for Dems to choke on

  • ZIP

Zero to get excited about. Meaningless non-binding resolution, the tax still stands and will be enforced.

  • SpinMeNot

I am glad they’ve voted for sanity — the problem is that unless the behemoth is stopped in its tracks, all this does is increase the amount of debt and deficit that Obamacare will create. We can’t just remove the sources of funding — those that believe that Obamacare benefits anyone other than the insurance companies and power mongers will press on with implementation regardless of the consequences.

The law must be overturned in its entirely, as pointed out by @trixiewoobeans:disqus.

  • Rulz

Didn’t Rush Limbaugh once say that the left-wing fall-back position was conservatism?

  • Jillane Kent

Though I would have preferred such an inane tax to be passed in the first place, I will give them credit for repealing this one. Even the most ardent supporter of the bill could never justify it’s inclusion. Though it is non binding, it should force the President’s hand.

    • IceColdTroll

NOT repealed — not yet. Read again, it’s still just showmanship. But a “moral victory,” if nothing else.

  • Booker

Ohh. We are gonna have so much fun when the full weight of this law comes crashing down on the liberals. They’ll be angrier than us!

  • Garth Haycock

While this is a step in the right direction and I’m happy that the Senate did this, I want to remind all those in the states who have Senators who are Democrats that those idiots forced Obamacare down our throats in the first place. Just because they voted to repeal the medical device tax is no reason to reelect them. We as a country need you folks to send them home.

As for my Senator, Mr. Hatch, I want to say to you personally to STFU. The only thing right you’ve really done in the last 24 years is vote against Obamacare.

    • trixiewoobeans

True dat! Any idiots who passed a law without reading it first HAS GOTS TO GO! Can I hear an AMEN?!!

  • Scott Anderson

I thought the law was written with a provision that it could only be amended or repealed by a 2/3 vote.

  • HARP2

Just shows that POLS only care about THEIR jobs.

  • Cory

That’s nice, now how bout restoring the doc fix for Medicare. What they are paying us is pennies on the dollar for the services we provide.

  • Charity Lambert

No more Obama or Obamacare. This is not going to help Americans. Our country and people are suffering at the hands of a mad man we have as CIC. This has got to stop. Obama needs impeached. Lybia deaths of our own people. our soldiers show that. numerous lies and deciet. How can anyone agree with such a non God fearing and God loving man? We need a true Christian president. Shame on america for voting him in the 1st time. disgraceful to happen the 2nd. I’m not so sure it did. not legally. God bless and be with us all. God bless america.. I pray for God’s hands to heal this country. this world. Scary times.

  • PopArt

Yes, let’s be encouraged that the Senate felt compelled to address this. But keep in mind that this is a NON-BINDING RESOLUTION. Not even actual legislation. This is the Congressional equivalent of wringing their hands and bemoaning the fact this evil device tax exists. No more than that? This is just a ploy for many of them, including Senators at risk in the 2014 races to say “SEE! Looky here, we DID vote to repeal Obamacare!” We can’t let up. We need to let the know that we are on to them! This RESOLUTION does nothing. Demand actual repeal legislation and see how they respond.

  • Frustrated Teacher

But now the issue is….what exactly will off-set the $20 billion dollar hole this will leave in funding Obamacare. I have a sneaky suspicious that Mr “I have more wiggle room” will just propose another tax hike on ‘the rich’ to pay for it. The problem is the whole thing doesn’t work and HAS to be repealed now that we can ‘see what’s in it’.

  • Jay

Stupidity is directly linked to your location. I bet Donald can’t fix cars or build houses, so to mechanics and carpenters he is “stupid”. Actually, he’s just ignorant concerning it, but the two words are often used interchangably these days.

  • Stan

I wonder if Pelosi knows what is in the bill now that it has passed. At least Dem’s are aware that their job’s are at stake.

  • arttie
