At last: White House addresses petition to deport Piers Morgan

The long national wait is over! The White House has finally seen fit to address the popular petition to deport Piers Morgan over his asinine remarks on the Second Amendment:

Let’s not let arguments over the Constitution’s Second Amendment violate the spirit of its First. President Obama believes that the Second Amendment guarantees an individual right to bear arms. However, the Constitution not only guarantees an individual right to bear arms, but also enshrines the freedom of speech and the freedom of the press — fundamental principles that are essential to our democracy. Americans may disagree on matters of public policy and express those disagreements vigorously, but no one should be punished by the government simply because he or she expressed a view on the Second Amendment — or any other matter of public concern.

We’re glad the White House is standing up for Piers Morgan’s First Amendment rights. We just wish we could be confident it would stand up for Second Amendment rights, too.

      The Constitution is applicable to all persons that fall within the jurisdiction of the United States, citizen and non-citizen alike.

          Correct. Musket has no Constitutional right to his presence here in the U.S., but while he is here (hopefully not long), our Constitutional rights are applicable to him (unless of course they are expressly reserved for citizens – i.e. voting).

          EDIT: see post by “ike” in this thread regarding the limitations of 1st Amendment rights of foreign nationals as established by Supreme Court decisions.

    “In response Morgan tweeted: “Ironic U.S. gun rights campaign to deport me for ‘attacking 2nd Amendment rights’ – is my opinion not protected under 1st Amendment rights?” We tweeted back: “Your opinion is protected, your presence in the U.S. is not.”

    We directed Morgan to Kleindienst v. Mandel, a 1972 case in which the U.S. Supreme Court upheld the denial of a visa to “a Belgian journalist and Marxian theoretician” who had been invited to an academic conference in America. This led to a bit of confusion, as the Daily Caller published a story titled “Wall Street Journal Columnist Explains on Twitter How to Deport Piers Morgan.””

    In lazily arguing, “Let’s not let arguments over the Constitution’s Second Amendment violate the spirit of its First,” Carney is implying that Piers Morgan’s anti-gun crusade is protected by free speech under the first amendment when it clearly isn’t since foreign nationals do not have absolute first amendment rights.

    The fact that the first amendment does not apply to non-citizens was established in the Supreme Court’s affirmation of Bluman v. FEC in January 2012. The court’s decision rubber-stamped a District Court decision which found under its first amendment analysis that, “The United States has a compelling interest in limiting the participation of foreign citizens in such activities, and “thereby preventing foreign influence over the U.S. political process.”

    Legal precedent also dictates that foreign nationals can be deported from the United States for subversion against the Constitution. In Harisiades v. Shaugnessy (1952), the US Supreme Court upheld Harisiades’ deportation by ruling that the first amendment did not protect Harisiades’ membership of the Communist Party.

    In issuing its glib response, the White House has completely failed to even address these cases and has erroneously claimed that the first amendment applies to non-citizen foreign nationals like Piers Morgan, when it does not.

    The fact that the White House’s response was timed to coincide precisely with the national media furore over Alex Jones’ appearance on CNN’s Piers Morgan Tonight is also curiously synchronous, given that Jones was the author of the original petition and Morgan is a personal friend of the Obama’s.

      We still have laws on the books that prevent foreigners from owning radio stations here because of Hitler, we should look into updating those laws to prevent foreigners, especially the British, from owning tv stations or newspapers here as well. We can’t let foreign propagandists,like Piers Morgan, “exercise their (non-existent) First Amendment rights” to the detriment of OUR rights.

      Our rights are OUR rights. The foreigners don’t deserve them, and they just want to take them away from US by using one right to undermine another anyway.

    The White House got it wrong. The 1st Amendment protects Morgan from prosecution for what he says. It does not protect his presence in the US. SCOTUS ruled on this in 1972 when the Nixon administration refused a visa to a journo from a communist bloc country.

    People need to calm down and look at the facts, which are on our side as they almost always are.

    -Areas with conceal/carry are even safer than Europe

    -Mass shootings are much more prone in areas with gun control

    -Gun control cities have several times the murder rate. In places, more Americans were dying from violence in gun control areas than in wars

    -Gun control in this country wasn’t dreamt up by some utopian free-thinker. It was pushed in New York because big crime bosses were tired of victims shooting back at their thugs.

    Emotional tirades on the internet and CNN is exactly how we got the election results of 06, 08, and 12.
